该通函阐述了相关适用范围、认可组织机构、检查和认证要求、船上投诉程序、财务担保要求以及主管机关联系方式等.
为满足《2006年海事劳工公约》规则4.
1、标准4.
1第4款以及第MLC002号通函-第1次修订版所附DMLC第I部分第12.
3款之要求,同时下发MLC003通函,提供了有关圣文森特和格林纳丁斯旗船舶的船上医疗指南.
我社在对SVG船旗船舶MLC检查认证过程中应严格参照上述通函要求执行.

导言1.
12010年11月9日,圣文森特和格林纳丁斯(SVG)向国际劳工组织(ILO)递交了其批准MLC,2006文件,成为第十一个批约的海事国家.

2.
适用范围2.
1船舶.
1MLC,2006适用于经常从事商业活动的所有船舶,无论其为公有或私有,以下情况除外:.
1专门在内河或在遮蔽水域之内或其紧邻水域或适用港口规定的区域航行的船舶以外的船舶;.
2从事捕鱼或类似捕捞的船舶;.
3用传统方法制造的船舶,例如独桅三角帆船和舢板;以及.
4军舰或军辅船.

2商业活动系指以获取收入为目的而开展的任何海事活动.

3圣文森特和格林纳丁斯海事管理局(主管机关)将确定圣文森特和格林纳丁斯遮蔽水域或其紧邻水域或港口条例适用的水域.

2例外和免除.
1经有关船东或海员组织协商后,主管机关可以确定MLC,2006的守则中的全部或任何不应适用于非国际航行的200总吨以下的船舶的要求,并向国际劳工组织劳工局长以及其它相关方通报此类例外和免除.

3海员.
1MLC,2006适用于所有海员.

1海员系指在MLC,2006所适用的船舶上以任何职务受雇、从业或工作的任何人员.
.
2根据国际劳工组织在日内瓦召开的国际劳工大会第94次(海事)会议于2006年2月22日通过的第7号决议,"海员"一词系指船上工作的船长及每个人,包括零售店店主、居民艺人、理发师以及类似人员.
.
2其工作不属于船舶日常业务范围且其主要营业地点位于岸上的人员不在海员范畴之列.
因此,以下类别的人员不应视为海员:.
1科学家、研究人员、潜水员、离岸专业技术人员等,其工作不属于船舶日常操作部分;.
2虽然接受过海上技能培训并取得资格,同时还具备主要专业人员功能,但港口引水员、检查员、验船师、审核员和机务监督员的工作不属于船舶日常操作部分;.
3嘉宾艺人、维修技师、码头工人,其从事临时、短期性工作,且其主要受雇地点位于岸上;以及.
4按照外包服务协议聘用的非海事人员,因协议条款确定服务供应商将提供的必要人员.

3如果对某一类人员是否属于海员范畴存在疑问,该疑问应由主管机关与相关船东和海员组织协商后确定.
3.
免除3.
1MLC,2006允许对标题三(起居舱室、娱乐设施、食品、膳食服务和水)进行免除的事项非常有限.
3.
2免除事项只能经与有关海员和船东组织协商一致或通过ILO三方专门委员会达成一致.
3.
3主管机关强烈建议船东如有可能不要依赖免除,尽量争取完全符合,因为这二者预计都会是漫长的过程.
3.
4根据标准A3.
1第20款的规定,对200总吨以下的船舶,考虑到船舶大小以及船上人员数量,若合理,船东可以寻求获得对起居舱室要求的免除.
此类要求免除的申请应有充分理由作为证明,并能保护海员的健康和安全.

5希望获得免除的船东应在签发该船舶DMLCPartI的申请前,向主管机关提交免除申请.
4.
认可组织和检查员4.
1主管机关将在第4.
2条中规定的范围内将MLC,2006要求的检查和认证职能授权给以下认可组织:美国船级社(ABS)法国国际检验局(BV)中国船级社(CCS)克罗地亚船舶登记局(CRS)挪威船级社(DNV)德国劳氏船级社(GL)印度船级社(IRS)国际海军调查局(INSB)希腊船舶登记局(HRS)韩国船级社(KR)劳氏船级社(LR)日本船级社(NKK)波兰船舶登记局(PRS)意大利船级社(RINA)俄罗斯船舶登记局(RS)4.
2认可组织可开展的检查和认证职能包括:.
1批准涉及MLC,2006标题三的图纸;.
2批准海事劳工符合声明第II部分;.
3临时检查并签发证书;.
4初次检查并签发短期证书;.
5中期检查并对证书进行签注;.
6换证检查并签发短期证书;.
7撤销证书;.
8要求对检查中发现缺陷进行整改;.
9根据港口国的要求对港口国控制检查中发现的缺陷的整改情况进行检查;以及.
10按照主管机关具体授权进行投诉调查.
解决投诉的责任仍然由SVG负责.

3主管机关可以基于个案处理的原则,授权具备资质的检查员(接受过标准5.
1.

4中规定的培训并具备适任能力)履行第4.
2条中涉及的任何或全部功能并承担本通函中描述的相关活动.
5.
检查和认证5.
1一般要求.
1MLC,2006要求所有500总吨及以上的船舶随船携带海事劳工证书.
该要求对500总吨以下且不从事国际航行或外国港口间航行的船舶为非强制性要求.
若有要求,该证书可按照自愿形式予以签发.
.
2无论认证与否,MLC,2006生效后,所有从事国际贸易的船舶均应遵守其要求.
.
3主管机关建议500总吨以下船舶的船东/管理人员自愿申请一份符合证明,以减少在港口国控制检查时可能遇到的问题.
然而,此类船舶仍需进行检查,认可组织应提供相关的船上检查报告.
.
4主管机关强烈建议船舶/管理人员尽快申请MLC,2006认证.
所有适用船舶必须在2013年8月20日完成MLC,2006检查和认证.
.
5作为认证流程的一部分,将对DMLC(适用时)中规定的工作和生活条件的遵守情况以及对MLC,2006要求的符合情况进行验证.
.
6海事劳工证书初次、临时或换证检查的范围应包括MLC,2006附录A5-I中涉及的十四个领域.

2起居舱室与船上娱乐设施5.

1新建船舶.
1除包括具有有限出租权限的游乐游艇在内的游乐船只外,新建船舶的起居舱室和船上娱乐设施应符合MLC,2006标准3.
1第6至17款以及B部分第3.
1款的规定.
允许因海员在各种及独特宗教和社会实践方面的权益而做出的变动.

2现有船舶.
1现有船舶系指龙骨安放日期早于2013年8月20日—即MLC,2006生效日期的船舶.

2现有船舶应由认可组织或检查员实施检查,确保起居舱室和娱乐设施干净整洁,并维持促进海员的健康和福利的状态.
.
3现有船舶应符合ILO第C92号和第C133号公约有关起居舱室和娱乐设施的要求(详见ILO《MLC,2006船旗国检查指南》—ILOISBN:987-92-2-121741-1.
这些指南在规则3.
1第2款中规定,对于MLC,2006生效之前已经存在的船舶,应就海员的起居舱室和娱乐设施实施检查,以验证该船舶根据国家立法向船上工作和/或生活的船员提供并保持与促进海员健康和福利一致的体面起居舱室和娱乐设施).

3船东/管理人获取MLC,2006认证(初次检查)的程序.
1船东/管理人应针对SVG实施规则(包括DMLC第I部分)对船舶和公司政策开展一次差距分析.

2差距分析所反映出的任何问题均应与相关认可组织或检查员进行讨论.

3船东/管理人应形成符合MLC,2006要求的文件化程序.
船长应熟悉MLC,2006的要求并负责实施.
.
4船东/管理人应向主管机关正式申请签发特定船舶的DMLC第I部分.
.
5审核任何所申请的免除或实质性等效条款时,可能要求支付额外的费用.

6DMLC第I部分由主管机关签发,并抄送一份给认可组织.
PDF版本会通过电子邮件发送给船东,同时文件正本亦会邮寄给船东.
,若有时,DMLC第I部分将包括主管机关授权的免除事项和/或实质性等效条款.

7为使船舶准备初次MLC,2006检查,船舶/管理人应完成DMLC第II部分的编制,该文件可在主管机关的网站上获取.
可以咨询认可组织或检查员寻求一般性指导.
编制DMLC第II部分时,船东应遵循MLC,2006附录B5-I所提供的范本的指导.

8船舶/管理人编制的DMLC第II部分应与针对该船舶的DMLC第I部分一起提交给认可组织,供其审查和接受DMLC第II部分.

9完成对DMLC第I部分和DMLC第II部分的审查且接受DMLC第II部分后,该船舶的初次MLC,2006检查应与认可组织协商一致.
(请注意审查并接受DMLC第II部分的工作亦可于初次MLC,2006检查期间在船上开展)主管机关强烈建议船舶/管理人及时向认可组织提交DMLC第II部分,以获得充足时间纠正缺陷项.

10初次检查满意地完成后,认可组织应签发有效期为最长五个月的短期海事劳工证书并批准DMLC第II部分.
(主管机关签发的)DMLC第I部分正本以及(船东/管理人编制并经认可组织批准的)DMLC第II部分均应与(认可组织签发的)海上劳工短期证书一起随船保存.

11认可组织应尽快转送一份短期海事劳工证书、DMLC第I部分、DMLC第II部分以及检查报告/检查日志等文件的副本至主管机关.

12船东/管理人应向主管机关申请签发长期海事劳工证书.
申请应于初次检查日期后三个月内向主管机关提交.

5.
4船东/管理人获取临时海事劳工证书的程序.
1具有以下情形的,可签发临时海事劳工证书:.
1刚交付的新船;.
2当船舶改换船旗时;或.
3当船东承担了其以前未经营过的某一船舶的经营责任时.

2临时海事劳工证书可由认可组织签发,有效期不超过六个月.
临时证书不得展期或再签发.
.
3船东/管理人应针对SVG实施规则(包括DMLC第I部分)对船舶和公司政策开展一次差距分析.
.
4差距分析所反映出的任何问题均应与相关认可组织或检查员进行讨论.

5船东/管理人应建立符合MLC,2006要求的充足程序.
船长应熟悉MLC,2006的要求并负责在船上实施.

6船东/管理人应向主管机关申请签发特定船舶的DMLC第I部分.

7船东/管理人应安排认可组织对船舶实施临时MLC,2006检查.
临时海事劳工检查/认证不要求提供DMLC第II部分.

8临时MLC,2006检查满意地完成后,认可组织应签发临时海事劳工证书,有效期为期六个月.
临时海事劳工证书不得再次签发.

5.
5中间检查和海事劳工证书的签注.
1海事劳工证书的有效期将取决于中间检查的情况.
中间检查的范围和深度应与海事劳工证书换证检查相当.

2证书有效期为五年,且仅实施一次中间检查的,应在证书第二个周年日至第三个周年日之间实施检查.
.
3中间检查满意完成后,海事劳工证书应由认可组织进行签注.
.
4认可组织应于完成中间检查后三十日内向主管机关提交经签注的海事劳工证书副本和中间检查报告.
.
5中间检查未按要求(于第二个周年日至第三个周年日之间)实施的,海事劳工证书将失效.
5.
6换证检查和海事劳工证书的换新.
1海事劳工证书换证检查期间,需要对实施MLC,2006的所有国家要求(按初次检查要求)进行核查.
.
2现有海事劳工证书到期前三个月内由认可组织满意地完成换证检查的,认可组织应签发有效期为期五个月的短期海事劳工证书.
.
3应船东的要求并收到认可组织发送的换证检查报告和短期海事劳工证书后,主管机关将签发新的全期海事劳工证书.
该证书有效期为期五年,自现有海事劳工证书到期之日起开始计算.
.
4船东/管理人应向主管机关申请签发新的全期海事劳工证书.
申请应于换证检查日期后三个月内向主管机关提交.
.
5换证检查于现有证书到期前三个月前满意地完成的,新海事劳工证书的有效期从完成换证检查之日起不超过五年.
.
6证书到期时船舶不在港口的,主管机关可以延长证书的有效期.
延长有效期仅用于允许船舶完成其至核查港口的航行.
证书有效期因此目的获得延长的,延长期限不得超过三个月.
认可组织在签注延长事宜前,应查核主管机关批准该请求的书面证据.

7换证检查于现有证书到期之日后满意地完成的,新证书自换证检查完成之日起生效,有效期自现有证书到期之日起不超过五年.
5.
7证书的终止(失效).
1有以下情形的,海事劳工证书和海事劳工符合声明将失效:.
1未实施上述要求的检查;.
2证书在中间检查后未获得签注;.
3船舶/管理人不再负责该船舶的经营;.
4船舶转挂另一国旗臶;.
5船舶结构或设备已作出实质性变更;.
6未考虑实施MLC,2006的国家法律或条列或其它措施的修正内容.
5.
7海事劳工证书和DMLC的撤销.
1有证据表明存在严重或经常发生的缺陷,且未按要求采取纠正措施的,主管机关或认可组织将撤销海事劳工证书和DMLC.

8船旗的变更.
1为支持船舶在变更船旗时及时进行重新认证,(见上述5.

9DMLC第I部分和第II部分的重要性DMLC第I部分和第II部分极其重要.
第I部分叙述的是国家法律要求;第II部分叙述的是船东为了使法律最终生效而采取的船上措施.
这两个文件将有效构成海事劳工证书的签发标准或任何港口国控制或其它检查所依据的检查标准.

6.
船上投诉程序6.
1按照国家要求以及MLC,2006要求,船东必须强制性为船舶建立公平、有效和迅速处理海员投诉指控违反MLC,2006要求(包括海员权利)的船上程序.

2同时,船东亦必须强制性确保每位海员获得:.
1一份投诉程序副本;.
2船东的联系方式或负责处理和解决投诉的船东岸上代表的联系方式;.
3SVG负责接收投诉的联系点的联系方式.
(见第8.
2条),以及.
4海员居住国主管当局的联系方式.

3本程序应寻求在尽可能最低的层次解决投诉,但如果海员认为有必要的,不应阻止海员直接向船长、船东、主管机关或MLC,2006规定的海员居住国主管当局投诉.

4投诉系统应包括保护海员不受迫害.

5投诉系统应至少确保:.
1投诉海员简要描述其投诉;.
2投诉海员应在所投诉事件发生后七(7)日内或视具体情况以书面形式提交其投诉,并遵循以下级别顺序:上级高级船员部门负责人船长.

10第2款中规定的工作、高温或动火作业(如焊接和气割)、封闭或密闭场所作业、高空和船舷作业以及圣文森特和格林纳丁斯海事局(主管机关)经协商后可能确定的其它类型的工作.

体检证书(规则1.
2)2013航运条例第6条第2款.
1如果一个国家是MLC,2006的批约国,所有海员应持有根据经修正的《1978年STCW公约》(以下简称公约或STCW公约)签发的体检证书,该证书由该国授权可签发体检证书的医师签发.

体检证书应符合STCW公约中的标准并按照ILO/WHO导则中规定的程序签发.

海员的资格(规则1.
3)2013航运条例第6条第3款.
1除非海员经培训或经证明胜任或具备履行其职责的资格且成功地完成了船上个人安全培训,否则不得在船上工作.
根据STCW公约进行的培训和认证应视为满足本条的要求.

海员就业协议(规则2.
1)2013航运条例第6条第5款.
1每位海员均应获得一份满足《公约》标准A2.
1所规定的条件的就业协议.
集体谈判协议可以构成海员就业协议(SEA)的全部或部分内容.

2海员的就业情况应在圣文森特和格林纳丁斯海员证中予以记录.
.
3海员和船东提前终止海员就业协议的最短通知期限为七(7)天.
具备以下情形的,海员可以在七(7)天以内通知的情况下终止协议:.
1值得同情的理由;.
2船舶因强制性国际公约被滞留三十(30)天或以上;.
3船舶被扣留三十(30)天或以上;或.
4船舶拟驶往战乱区域,但船员不同意前往.

4具备以下情形的,船东可以在七(7)天以内通知的情况下终止协议:.
1船舶被售出或灭失;.
2海员因病或因伤不能继续履行其职责;或.
3海员被确定为不能适任或严重违反纪律5.
使用任何有许可证的或经发证或受管理的私营招募和安臵服务机构(规则1.
4)2013航运条例第6条第4款.
1圣文森特和格林纳丁斯境内的招募和安臵服务机构(SRPS)应获得主管机关的许可.

2船东应确保SRPS具备能确认其符合《公约》标准A1.
4及《公约》相关方授权其作为SRPS经营的文件.
船东应要求SRPS提供一份SRPS符合性和授权文件副本,并作为符合本规则的证据予以记录并保存.

(2013公报)为行使圣文森特和格林纳丁斯法律2009版第363章《航运法》第400(1)(ba)条赋予部长的权利,以及其它所有权力,特制订以下条例:1.
引用(1)本条例亦可引称为"2013航运条例(2006年海事劳工公约)".
2.
释义(1)除文中另有说明外,本条例中的术语定义如下:"法令"系指经修订的圣文森特和格林纳丁斯法律2009版第363章《航运法》;"主管机关"系指依据法令第393条而建立的海事管理局;"协商之后"系指与相关事宜所涉及的适当船东组织和海员组织协商之后,亦或,若无船东和海员组织的,与雇主组织和工人组织协商之后;"授权官员",就圣文森特和格林纳丁斯港口检查而言,系指根据法令第356条委任的检验员或检查员;"公约"系指2006年2月23日在日内瓦通过的《2006年海事劳工公约》,以及[对圣文森特和格林纳丁斯而言]暂时生效的任何修正案;"导则"系指守则B部分中的导则;"标准"系指守则A部分中的标准;"守则"系公约的组成部分,包括与本条例的实施以及[对圣文森特和格林纳丁斯而言]暂时生效的任何修正案有关的A部分(强制性标准)和B部分(非强制性导则);"STCW公约"系指经修订的《1978年海员培训、发证和值班标准国际公约》.

(2)本条例中所使用的术语亦用于公约的,其含义应与公约中的含义一致.
(3)本条例中凡引述实用守则的,该引述之守则应视为暂时生效.
(4)就本条例和公约而言,"主管当局"对圣文森特和格林纳丁斯而言,系指依据法令第356条任命的局长;3.
适用范围(1)(a)本条例适用于所有海员.
(b)对某一类人员是否属于海员范畴存在疑问的,应由主管机关经协商之后予以确定.
(2)(a)除从事捕鱼或类似活动的船舶外,本条例适用于经常从事商业活动的所有船舶,无论其为公有或私有.
本条例不适用于军舰、军事辅助船以及圣文森特和格林纳丁斯政府拥有或经营的其它非商用船舶.
(b)对本条例是否适用于某一船舶或某一特定类别的船舶存在疑问的,应由主管机关经协商之后予以确定.
(3)(a)除第7(5)条外,本条例适用于所有圣文森特和格林纳丁斯旗船舶.
(b)第7(5)条以及第9至12条适用于位于圣文森特和格林纳丁斯水域的非圣文森特和格林纳丁斯旗船舶.
4.
条例目的(1)本条例旨在实施《2006年海事劳工公约》并确保每位海员有权享有:(a)符合安全标准的安全且受保护的工作场所;(b)公平的就业条件;(c)体面的船上工作和生活条件;以及(d)健康保护、医疗、福利措施及其它形式的社会保护.
5.
例外和免除(1)根据公约第二条第6款,经协商之后,主管机关可以确定守则的全部或任何要求不适用于小于200总吨且不从事国际航行的船舶.
(2)主管机关应就圣文森特和格林纳丁斯的遮蔽水域或遮蔽水域之紧邻水域或适用港口规定的水域做出明确界定.
6.
适用程序(1)程序(第2栏规定了本条例以及公约守则的义务并包含了其配套规定)应适用.

7.
一般符合性责任(1)圣文森特和格林纳丁斯旗船舶的船东和船长有责任遵守并确保其船舶符合本条例之要求.
(2)具有以下情形的任何人均应承担符合或确保符合本条例规定的责任:(a)负有本条例规定之强制义务者;或(b)依据本条例,已向其指明符合或确保符合本条例之方向者(不论是根据第(1)款或其它条款)视具体情况而定.
(3)(a)除船东或船长以外的自然人或法人,因其对船舶经营方面负有责任而对上述第(1)款相关事宜拥有控制权的,上述第(1)款项下的任何强制性责任应延伸至对该事宜拥有控制权的人员.
(b)船东和船长有责任采取一切合理措施,确保本款第(a)条中所述的人员知晓其责任且能够履行责任.
(4)(a)在遵守本条例规定的任何要求时,行为人应考虑到相关的导则;这一行为可作为被指控违反所采取的措施系根据守则B部分导则相关规定的抗辩.
(b)有关附表的意义或程度的任何疑问,可按照相关导则确定.
(5)任何非圣文森特和格林纳丁斯旗船舶位于圣文森特和格林纳丁斯水域时,其船东和船长有责任按照船旗国主管当局确定的方式遵守公约要求.
船舶所挂旗臶的国家不是公约缔约国的,船东和船长应确保船舶符合公约规定的标准.
8.
文件的携带(1)本条例适用的所有圣文森特和格林纳丁斯旗船舶均应携带一份公约副本以及一份本条例的副本,以供船上工作的所有海员取阅.
9.
滞留(1)凡不符合本条例的船舶均可能受到滞留,但不得对其进行不当延误或滞留.

罚则(1)第7条第(1)、(2)、(3)(a)或(5)款所述人员违反相关规定的,该名人员即构成违法行为,经循简易程序定罪,最高可处罚款3万美元,或判处6年以下有期徒刑,或同时处以罚款和有期徒刑;(2)在本条第(1)款所述违法行为的诉讼程序中,作为抗辩,船东或船长可证明其并不拥有相关违法事宜的控制权,因其在船舶经营方面没有责任并且符合第7(3)(b)之规定.
11.
欺诈、滥用证书等(1)任何人不得:(a)未经合法授权,擅自变更根据公约或本条例签发的证书或声明;(b)对公约中所涉及的证书和声明造假;(c)明知或罔顾实情提供与公约所规定的任何检查相关的虚假信息;(d)意图欺骗、使用、出借或允许他人使用公约中所涉及的证书或声明;(e)拒绝交出应上交的依据公约签发的证书和声明.
(2)违反本条第(1)款的,即构成违法行为,经循简易程序定罪,最高可处罚款3万美元,或判处6年以下有期徒刑,或同时处以罚款和有期徒刑.
12.
与检查有关的违法行为(1)任何人:(a)妨碍任何检查员或授权官员行使附表中的权力的;或(b)在无合理辩解的情况下,未能满足检查员或授权官员行使附表中的权力时所做出的任何要求;(c)针对检查员或授权官员行使附表中的权力时所提出的问题,故意提供虚假回答即构成违法行为,经循简易程序定罪,最高可处罚款5千美元,或判处6个月以下有期徒刑,或同时处以罚款和有期徒刑.
13.
生效日期本条例自2013年4月1日起开始生效.
附表第6条款国家要求标题1海员船上工作的最低要求1最低年龄(a)不足16岁者不得在船上受雇、从业或工作.
(b)除第(c)款规定外,18岁以下海员不得在夜间工作;"夜间"系指从不晚于晚上9点开始至不早于上午6点钟结束的一段至少9个小时的时段.
(c)主管当局可在以下情况允许未成年海员夜间工作:(i)根据已经确定的项目和日程安排,有关船员的有效培训将被扰乱;或(ii)职责的具体性质或所认可的培训项目要求涉及到的海员需履行夜间职责,且主管机关协商后确定该工作不会对他们的健康或福利产生有害影响.
(d)除非未成年海员经过培训并由工作领域内对应行业机构认可具备适任能力,否则,18岁以下海员不得受雇或聘用或在船上从事以下类型的工作:(i)公约导则B4.

10第2款(a-l)列举的工作;(ii)热工,如焊接、气割;(iii)在封闭或受限处所工作;(iv)高空作业;(v)舷外作业;(vi)船上厨师工作;或(vii)主管机关经协商后确定可能对海员健康或安全造成危害的其它类型工作.
2体检证书(a)所有船东应确保所有海员在上船工作之前持有有效的体检证书,证明其健康状况适合在海上履行指定的职责.
(b)有效的体检证书是指在签发国由授权医师根据STCW公约规则I/9要求签发的证书,前提是:(i)签发体检证书的国家是MLC,2006公约或STCW公约的缔约国;以及(ii)体检证书格式符合《ILO/WHO海员上船工作前和定期体格健康检查实施指南》,包括其任何修订版本.
(c)标准A1.
2第3款至第10款适用于健康检查、体检证书和证书有效期.
(d)如果海员持有的体检证书已失效,但不能够及时换证,主管机关可根据船东出具的申请书允许该海员随船航行一段时间,但期限不得超过体检证书失效日期后的3个月.
(e)代表圣文森特和格林纳丁斯当局执行健康检查并签发体检证书的医师至少应满足以下要求:(i)持证医师;(ii)具有综合医学和职业医学或海事职业医学经验;(iii)通过专门指导或个人海员服务经验,了解船上工作和生活状况;(iv)熟悉ILO/WHO出版物包含的指南,如ILO/WHO海员上船工作前和定期体格健康检查实施指南》(ILO/WHO/D.
2/1997)或其任何修订版本的出版物;(v)在实施健康检查程序时,保持相对与雇主、工人及其代表的医学判断的职业独立性;以及(vi)熟悉世界卫生组织出版物、《国际船舶医疗指南》或供船上使用的等效医疗指南的内容.
3培训和资格(a)根据(b)款规定,适用于STCW公约在圣文森特和格林纳丁斯旗船舶上受雇的所有海员,必须根据该公约中对其船上职责的规定要求接受培训并合格.
(b)上船工作前,海员必须接受相应职责的熟悉培训和指导.
4招募和安臵(a)在圣文森特和格林纳丁斯境内,以招募和安臵海员或招募和安臵相当数量海员为主要目的的私营海员招募和安臵服务机构的经营人,应确保其服务依照主管机关发放的许可证进行运营.
(b)主管机关只有在协商后才能制订、修改或变更许可体系.
如果就本条款是否适用于某一招募和安臵服务机构存在疑问,应由主管机关协商后予以决定.
(c)条款(a)及(b)也适用于经主管机关协商认定适用且在圣文森特和格林纳丁斯境内运营招募和安臵服务的海员组织,其向悬挂该国旗船舶提供圣文森特和格林纳丁斯国籍海员.
(d)第(c)款所述的招募和安臵服务机构系指:(i)根据该组织与船东之间所达成的集体谈判协议运作的服务机构;(ii)其所涉及的海员组织和船舶均位于圣文森特和格林纳丁斯境内的服务机构;以及(iii)主管机关批准的集体谈判协议中允许提供招募和安臵服务的服务机构.
(e)经营人应确保第(c)项所述的招募和安臵服务机构以有序的方式运营,并应将与第(g)项所述规定相当的保护和促进海员就业权利的措施实施到位.
(f)任何海员招募和安臵服务机构不得:(i)利用各种方式、机制或清单阻止或阻挠海员获得其适任的工作;或(ii)除国家法定体检证书、国家海员服务簿、护照或其它类似个人旅行证件的费用外,不得要求海员直接或间接承担招募或安臵服务或向其提供就业的费用或其它收费,但除外的费用不包括签证费,签证费应由船东承担.
(g)圣文森特和格林纳丁斯海员招募和安臵服务机构应:(i)维护一份其所招募或安臵所有海员的最新登记册,以备主管当局检查;(ii)确保海员在受聘前或受聘过程中被告知其在就业协议上的权利和职责,并为海员在签署就业协议之前和之后对之进行核阅以及适当的安排使他们能够收到一份该协议的副本;(iii)核实被其招募和安臵的海员有资质并持有相关工作所要求的文件,并核实海员就业协议符合所适用的法律、条例和构成就业协议组成部分的集体谈判协议;(iv)尽实际可能保证船东有保护海员免于流落外国港口的措施;(v)对有关其活动的任何投诉进行核查并做出反应,并将任何未解决的投诉报告主管机关;以及(vi)建立一个保护机制,通过保险或适当的等效措施,赔偿由于招募和安臵服务机构或有关船东未能按就业协议履行对海员的义务而可能给海员造成的资金损失.
(h)各船东有义务:(i)确定其为圣文森特和格林纳丁斯船舶上的海员招募和安臵而使用的服务机构满足以下要求:(1)有效执照、证书或其它证明的持有人居住在本公约适用的国家或领土;这些证明可由本公约适用的其它国家和领土主管当局签发,以证明符合规则标准A.

(2)在本公约不适用的国家或领土内设立的海员招募和安臵服务机构,应尽实际可能符合公约标准A1.

(f)海员和船东在船上提前终止海员就业协议发出预先通知的最短期限应为七天.
(g)如遇以下情形之一,海员有权无需发出通知即可终止就业协议,且不受任何处罚以及满足任何确立的集体谈判协议规定:(i)海员配偶、伴侣或孩子去世或身患重大疾病,或其父母去世或身患重大疾病等出于同情的理由;(ii)因船舶不符合本公约、SOLAS公约或载重线公约条款且因此被滞留30天;(iii)海员所服务的船舶被扣留或已扣留达30天;或(iv)海员所服务的船舶即将驶入船舶保险公司规定的或海员不同意前往的具有战争危险的区域.
(h)任何情况下出现以下情况之一时,船东可无需通告或至少提前7天发出通告要求终止海员就业协议:(i)船舶变卖;(ii)船舶灭失;(iii)海员因受伤或生病而无法继续在船上履行职责;或(iv)根据约定的纪律程序确定海员无胜任能力或参与严重的不正当行为.

(b)海员应得的报酬应按照不超过一个月的间隔并根据海员就业协议或任何集体谈判协议进行支付;以及(c)应给海员一个应得报酬和实付数额的月薪账目,且至少明确以下内容:(i)工资;(ii)额外报酬;以及(iii)在其报酬采用的货币或兑换率不同于曾经达成一致的货币或兑换率时,所用的兑换率.

(h)部长可根据主管机关通过协商给出的建议,公布在圣文森特和格林纳丁斯船舶上工作海员所适用的最低工资级别表.
7休息时间(a)"休息时间"一词系指要求海员为船舶工作的时间,不包括少于一小时的短暂休息.
(b)除非第(a)项做出规定,海员所享有的最短休息时间应不少于:(i)在任何24小时时段内不得少于10小时;且(ii)在任何7天期间内不可少于77小时.
(c)休息时间最多可分为两段,其中一段至少要有6小时,且相连的两段休息时间的间隔不得超过14小时.
(d)海员随时待命期间可视为休息时间,前提是该时间内不被招去工作;如果期间海员被招去工作,则应给予充分的补休.
(e)集合、救生艇训练、保安演练以及圣文森特和格林纳丁斯法律和适用的海事公约规定的训练应以对休息时间的影响最小和不会造成疲劳的方式安排.
(f)如果出现紧急情况或其它意外操作状况,无需遵守第(b)项和第(c)项的要求,但前提条件是情况结束后,参与海员能够得到适当的补休,避免发生疲劳.
(g)主管机关可通过协商同意和批准与第(b)项和第(c)项的标准有差异的集体谈判协议,允许增加休假次数或长度,或对在短途航行船舶上工作的海员准予补休,但前提条件是该协议遵循标准制定目的.
(h)对于受雇作为值班高级船员或值班普通海员或职责涉及安全指定、防污或保安职责的海员,可免除第(c)项要求,但前提条件是:(i)这些海员在任何7天时间内休息时间不少于70小时;(ii)任何例外情况不得持续两周以上;以及(iii)任何两段例外时间间隔不得少于例外时间.
(i)对于受雇作为值班高级船员或值班普通海员或职责涉及安全指定、防污或保安职责的海员,可例外将第(b)项中的休息时间最多分为三段,而不是两段,但前提条件是:(i)其中一段至少要有6小时,其它两段至少要1小时;(ii)相连的两段休息时间的间隔不得超过14小时;以及在任何7天时间内,例外情况不得超过两个24小时时间段.
(j)第(b)项、第(c)项、第(h)项或第(i)项的任何规定不得妨碍船长出于船舶、船上人员或货物的紧急安全需要,或出于帮助海上遇险的其它船舶或人员的目的而要求一名海员从事任何时间工作的权利.
船长可中止工作时间或休息时间安排,要求一名海员从事任何时间的必要工作,直至情况恢复正常.
一旦情况恢复正常,船长应尽快地确保所有在计划安排的休息时间内从事工作的海员获得充足的休息时间.
(k)船上工作安排表应根据标准A2.
3第10款规定张贴;工作安排表用英文和船舶工作语言(非英语)编制,其格式应采用IMO/ILO出版的《海员船上工作安排表编制指南》和《海员工作时间或休息时间记录格式》或经认可的相同格式.
(l)应保持对海员的日工作时间或日休息时间进行记录,并将其副本放臵在船上保留3年.

(m)海员应得到一份由船长或船长授权人员以及海员本人签字认可的有关其本人记录的副本.
(n)电子格式的记录可视为满足第(1)项和第(m)项要求,但前提条件是:(i)所有海员随时可查看个人记录;(ii)所有海员在合理的时间下能够获得打印副本;(iii)记录由海员本人和船长或船长授权人员通过电子签字;(iv)记录一经签字将不得随意篡改,并可供港口国控制官员、圣文森特和格林纳丁斯检查员和授权官员使用;(v)记录供船上使用的期限至少为3年;以及(vi)记录所采用的格式应认可与IMO/ILO指南相同.
8休假(a)船上海员享有带薪年度休假的权利,年度休假至少以每工作一个月有2.
5日历天为基础加以计算,其中,工资应按海员正常的基本工资费率或任何集体谈判协议中规定的较高费率进行支付.
(b)合理的缺勤、船上工作时因患病或受伤造成的缺勤和因参加认可的海事职业培训班造成的缺勤均不得视为年假.
为海员提供的临时岸上休息和圣文森特和格林纳丁斯公共节假日不得视为带薪休假一部分.
(c)禁止达成放弃享受最少带薪年休假的任何协议.
(d)如有可能,只要海员船上职务的工作要求允许,应准予海员上岸休息,且该岸上休息不能计算在年假内.
9遣返(a)根据本条例规定,各船舶应具有覆盖海员遣返费用的财务担保.

(c)海员在有权根据(b)(iii)项要求得到遣返前在船上服务的最长期间应在海员就业协议中予以规定,但无论任何情况下,均不得超过12个月.
(d)根据(b)项规定,在遣返方面将由船东承担的费用应至少包括以下项目:(i)遣返目的地;(ii)从海员离船时起至抵达遣返目的地时止的食宿费;(iii)从海员离船时起至抵达遣返目的地时止的工资和津贴;(iv)将海员个人行李30公斤运至遣返目的地的运输费;以及(v)必要时,提供医疗使海员身体状况适合前往遣返目的地的旅行.
(e)除非海员就业协议另有规定,遣返目的地应为海员受雇的位臵,或海员和船东双方同意采用另一种方法,且应采用乘坐飞机方式运将海员遣返至该目的地.
(f)不得要求海员在其受雇时或受雇前缴纳任何遣返费用.
遣返费用不得从海员工资或其它收入中扣除,除非发现海员出现严重失职.
(g)这些条例均不得妨碍船东根据第三方契约性安排收回遣返费用的任何权利.
(h)如船东未能为有权得到遣返的圣文森特和格林纳丁斯船舶服务海员安排遣返或负担其遣返费用:(i)主管机关应安排有关船员的遣返;以及(ii)主管机关应能够向船东索回为实现本义务要求而遣返海员时发生的费用.

(k)如果主管机关已按照第(h)项规定遣返海员,但仍未索回遣返发生的所有费用,可扣留该船舶,直至按航运法相关扣船条款要求做出偿付.
(l)如果海员就业协议中对具体的遣返要求未作准确规定,所有海员应随时通过适合的语言查阅本条例中的圣文森特和格林纳丁斯相关条款.
10海员赔偿(a)在船舶灭失或沉没的情况下,船东就这种灭失所造成的失业向船上每个海员支付赔偿;赔偿标准按海员最高两个月的基本工资计算.
(b)第(a)项内容均不得妨碍海员因船舶灭失或沉没应享有的其它任何损失或伤害赔偿权利.
11配员(a)所有船舶应配有数量足够并承担适合职务的海员,以确保船舶的营运安全和有效,并在各种条件下充分注意保安.
(b)船舶根据主管机关签发的安全配员证书配备船员时,应视为从数量和资格角度为船舶配备充足的船员.
标题3-起居舱室、娱乐设施、食品和膳食服务12起居舱室(a)船舶应按照第(f)项要求满足这些标准,以确保海员在船上工作和生活的任何起居舱室安全、体面.
(b)对于安放龙骨的船舶或于公约生效之日或之后建造的船舶,其船上起居舱室和娱乐设施应至少符合公约标准A3.

(d)适用于第(b)项的船舶应符合,为使标准A.

(f)对于需要视不同宗教和社会习惯的船员的利益给予非歧视性考虑的船舶,主管机关经协商可以允许根据第(b)项和第(c)项要求进行适当的调整.
(g)主管机关经协商可按照标准A3.
1第20款免除200总吨以下的船舶遵守第(b)项和第(c)项要求,但只有在特定的环境下此种免除有充分明显的理由时才可做出,并应以保护海员的健康和安全为前提.
(h)所有圣文森特和格林纳丁斯船舶的船长应确保每周对海员起居舱室进行检查,以证明海员起居舱室干净、体面地适宜居住,并且维护到良好的状态.
检查中发现的缺陷应立即予以纠正;包括发现的缺陷在内的检查结果应在船舶甲板日志中记录;检查记录应至少在船上保存3年,并随时可供检查员查阅.
13食品和膳食服务(a)船舶应随船携带并供应能充分满足船舶需求的合格、有营养和足够数量的食品和饮用水,同时考虑到不同的文化和宗教背景.
(b)海员受雇在船上工作期间,应向海员免费提供食品和饮用水.
(c)船东应确保设臵并装备膳食服务部门,以便为船员提供在良好卫生条件下准备和服务的充分、多品种和有营养的餐食.
(d)配员规模在10人或以上的船舶应配备一名适任、有资格的厨师.
(e)对于18岁或以上的厨师,其具有资格的条件如下:(i)持有以下组织和国家签发的有效证书:(1)主管机关批准或认可的组织;(2)本公约或《1946年船上厨师发证公约》(第69号)缔约国.
(ii)具有3个月担任二厨/助理厨师或5年膳食部服务生海上服务经验.
在每种情况下,其均应在厨房加工食品方面接受过包括食品和个人卫生以及船上处理和储存食品等培训;或(iii)持有商业烹饪行业有效的烹饪合格证书.
(f)第(e)(iii)项所述的"合格"系指得到公约其它签署国主管机关或主管当局的批准.
(g)对于配员规模10人以下的船舶或未配备厨师的船舶,船东应确保对厨房加工食品的任何人员均应在包括食品和个人卫生以及船上处理和储存食品等方面受到过培训或指导.
(h)由于情况特殊而无法配备具有正式资格的厨师时,或在要求配备正式资格厨师的船舶上工作的厨师需要离开的情况下,主管机关可签发特免证明,允许由另一人员在不超过一个月的有限时间内担任厨师,或直至下一个适宜的港口,以先到者为准.
但前提条件是担任厨师的这名人员在食品和个人卫生以及船上处理和储存食品方面受到过培训或指导.
(i)所有圣文森特和格林纳丁斯船舶船长应确保每周就以下几个方面进行检查:(i)食品和饮用水的供应;(ii)用于储存和处理食物和饮用水的场所和设备;以及(iii)用于准备和供应餐食的厨房或其它设备.

标题4-健康保护、医疗、福利和社会保障14船上和岸上医疗(a)凡可行且必要时,应给予圣文森特和格林纳丁斯船舶上的所有海员在任何停靠港及时去看医师或牙医的机会.
(b)应免费向船上海员或外国港口的海员提供医疗、必要的牙科治疗和健康防护服务.
(c)当船舶有必要为海员安排岸上医疗时,船长应使用附则A中的医疗报告表,便于海员治疗.
记录完成后应保密.
(d)船舶应符合标准A4.
1第4款第(a)项至第(c)项的要求.
(e)本表附则B规定的事项具有强制性.
15船东的责任(a)船东应满足标准A4.
2第1款第(a)项至第(d)项的要求.
(b)根据标准A4.
2第1(c)款规定,船东支付医疗和膳宿费用的责任限制在从受伤或患病之日起不少于16周的期限内.
如果海员能够根据强制疾病保险计划、强制事故保险计划或工人事故赔偿计划索取医疗保险,此后,船东将停止这种责任.
(c)如果疾病或受伤造成工作能力丧失,船东应有责任:(i)只要患病或受伤海员还留在船上或者在海员根据本条例得到遣返以前,向其支付全额工资;以及(ii)从海员被遣返或到达上岸之时起直到身体康复,或直到有权根据圣文森特和格林纳丁斯的法律获得保险金(如果早于康复的话),按照海员基本报酬或任何适用的集体谈判协议规定的费率向其支付工资.
(d)如果海员离船时间超过从患病或受伤之日起的16周,船东将按照第(b)项规定不承担支付工资的责任.
(e)根据第(b)或(c)项规定,出现以下情况时,船东将不负任何责任:(i)在船舶服务之外发生的其它受伤;(ii)受伤或患病是因患病、受伤或死亡海员的故意不当行为所致;以及(iii)在接受雇用时故意隐瞒的疾病或病症.
(f)只要此种责任由任何公共当局承担,船东可不用承担支付船上医疗费用及膳宿和丧葬费用的责任.
(g)船东应采取措施保护患病、受伤或死亡海员留在船上的财物并承担将其归还给海员的最近亲属时发生的合理费用.
16保护健康和安全(a)所有船东应采取措施,以确保海员的健康和安全,以及为其负责船舶上的海员提供安全、清洁、卫生的工作环境,从而保护海员职业健康.
(b)在不损害第(a)项所述的船东一般职责的情况下,关于职责范围延伸事项,应特别尽实际可能包括:(i)提供和维护场所、机械、设备和对健康无威胁的安全工作体系;(ii)为确保安全和物品和物质在使用、处理、装载和运输中对健康无任何风险而做的安排;(iii)为确保船上人员健康和安全向海员提供所需的信息、指导、培训和监督;(iv)维护船上所有安全且无健康风险的工作场所;以及(v)提供和维护安全且无健康风险的船上环境.
(c)船东应负责制定有关健康和安全的总方针的书面声明,并在适当的情况下经常对其修改,以及对实施该方针作出安排,并就该声明和任何修改向海员发出通知.
(d)对于在圣文森特和格林纳丁斯登记的船舶,职业健康、风险分析、安全工作规程、为减少臵身于有害水平的环境因素和化学品中的风险以及受伤或患病风险所采取的措施等方面的标准或规程应参考以下文件规定:(i)ILO准则-《1996年海上和港口防止船上事故》;以及(ii)主管机关不时发布的其它指导.
(e)所有圣文森特和格林纳丁斯船舶应随船携带一份最新版ILO准则-《1996年海上和港口防止船上事故》副本;该副本可为纸质版或电子版,但前提条件是所有海员能够随时就各自在船上所承担的职责查阅相应的内容.
(f)船东不得就按照第(b)或(d)项规定完成的事情向海员收取任何费用.
(g)任何圣文森特和格林纳丁斯船舶上发生的所有事故、伤害和疾病均应按照主管机关的要求第一时间向主管机关报告.
(h)圣文森特和格林纳丁斯船舶上的海员人数为5人或以上时,船东应安排成立安全委员会;该安全委员会应包括船上所有部门代表.
标题5-遵守与执行17认可组织(a)主管机关认可的国际船级社协会(IACS)成员船级社,由于主管机关与他们已经有协议且其能力满足公约规则5.

(b)出现下列情况时,可按照标准A5.

(c)500总吨以下的船舶无需携带海事劳工证书和海事劳工符合声明,但仍可选择这么做.
(d)出现以下情况时,按照本条例规定海事劳工证书和海事劳工符合声明将停止有效:(i)如果在公约规定的期限内没有完成检查;(ii)如果证书没有根据公约要求予以签注;(iii)如果船舶更换为其他船旗;(iv)如果船东不再承担某一船舶的经营责任;或(v)如果对公约标题3所包括的构造或设备做出了实质性改变.
(e)如果有证据表明有关船舶不符合本公约和本条例的要求且没有采取所要求的任何纠正措施,主管机关或作为其代表的认可组织可根据缺陷的严重性或出现次数撤销圣文森特和格林纳丁斯船舶上的海事劳工证书.
(f)在不损害航运法第XVIII部分(实施官员与权力)的情况下,应按照标准A5.

14第7(c)款内容均不得妨碍就行政措施向高级法院上诉的权利.
(i)如果船东证明检查员采取的措施不合理且不可能,部长应向其赔偿由此引起的损失.
19投诉(a)任何人不得迫害提交投诉的海员;迫害是一种违反本条例规则10规定的罚则的行为.
(b)所有船东应制定可供所有海员在其负责的船舶上使用的正式投诉程序;该程序应:(i)能够按最低层次寻求解决投诉的办法,但同时不得阻止海员直接向船长、船东、主管机关或在其认为必要或适宜时,向其居住国主管当局提交投诉申请.
(ii)向投诉海员提供在投诉程序期间由人陪同或由人代表的权利.
(iii)包括投诉海员免受迫害的保护措施;迫害包括由任何人因海员提出投诉而对其采取的任何不利行动,只要该投诉不是刁难或恶意而为.
(c)尽管有第(b)项的一般标准,但投诉程序仍应确保:(i)投诉交由投诉海员工作所在的部门负责人或其上级高级船员处理;(ii)部门负责人或上级高级船员应在七天内努力寻找解决办法;(iii)如果部门负责人或上级高级船员的解决方法失败,海员可将此事交由船长在七天内解决;(iv)允许投诉海员由其在船上选择的另一名海员陪同或代表;(v)记录所有投诉及其做出的决定,且该记录副本可供相关海员使用;(vi)如果投诉不能在船上得到解决,海员在十天内将此事交由岸上的船东或其代表在三十天内解决;(vii)船东或其代表和海员应在三十天期限内解决此事;(viii)如果三十天后此事仍未得到解决,任何一方均可在三十天内将此事交由主管机关寻求解决办法.
(d)应向所有海员提供一份由船东制定的船上投诉程序副本;该投诉程序提供主管机关联络信息以及海员居住国海事主管当局的联络信息.
(e)除了向所有海员提供投诉程序外,还应在保密的基础上向其提供公正的建议并在其它方面给予帮助的船上人员的姓名.
(f)根据公约第VI条规定,主管当局同意具有实质性等效的船上职务身份的出现满足第(e)项的要求.
20港口国控(a)所有非圣文森特和格林纳丁斯船舶在正常的业务航行中或出于操作性原因挂靠圣文森特和格林纳丁斯的港口时,可能受到目的在于核查该船符合本公约有关海员工作和生活条件要求(包括海员权利)情况的检查.
制(b)第(a)项所述的检查应由授权官员执行;检查行为(包括为此而采取的措施)应符合标准A5.

关于在不要求配备医生的船舶上应提供的医疗培训水平:(a)通常能够在8小时内获得合格的医疗和医疗设施的船舶应至少有一名接受过《STCW公约》所要求的经认可的医疗急救培训的指定海员,使其能够在船上可能发生事故或出现疾病时,能够立即采取有效行动和采用通过无线电或卫星通信获得的医疗建议;以及(b)所有其它船舶应至少有一名接受过《STCW公约》所要求的经认可的医疗培训的指定海员,包括实践培训以及诸如静脉治疗等抢救技能的培训,以使相关人员能有效参与船舶海上医疗援助协调活动,并在病号或伤员可能在船上停留的期间内向他们提供符合标准的医疗.

Exceptionsandexclusions(1)TheAdministrationmay,afterconsultation,determinethatalloranyoftherequirementsoftheCodeshallnotapplytoshipsoflessthan200grosstonsnotengagedoninternationalvoyages,inaccordancewithArticleII.

Detention(1)InanycasewhereashipdoesnotcomplywiththeseRegulations,theshipshallbeliabletobedetained,providedthatashipshallnotbeunreasonablydelayedordetained.
10.
Penalties(1)Whereapersonspecifiedinsub-regulation(1),(2),(3)(a)or(5)ofregulation7contravenestherespectivesub-regulationthatpersonisguiltyofanoffenceandisliableonsummaryconvictiontoafinenotexceedingthirtythousanddollars,ortoatermofimprisonmentnotexceedingsixyears,ortobothsuchfineandtermofimprisonment;(2)Inproceedingsforanoffenceundersub-regulation(1),itshallbeadefenceforashipownerormastertoprovethathedidnothavecontrolofthemattertowhichtheoffencerelatesbecausehedidnothaveresponsibilityforthataspectoftheoperationoftheshipandthatregulation7(3)(b)wascompliedwith.
11.
Fraud,misuseofcertificates,etc.
(1)Nopersonshall―(a)withoutvalidauthorityintentionallyalteracertificateordeclarationissuedforthepurposesoftheConventionortheseRegulations;(b)falselymakeacertificateordeclarationreferredtointheConvention;(c)knowinglyorrecklesslyfurnishfalseinformationinconnectionwithanyinspectionrequiredbytheConvention;(d)withintenttodeceive,use,lend,orallowtobeusedbyanother,acertificateordeclarationreferredtointheConvention;(e)failtosurrenderacertificateordeclarationtobesurrenderedissuedforthepurposesoftheConvention.
(2)Apersonwhocontravenessub-regulation(1)isguiltyofanoffenceandisliableonsummaryconvictiontoafinenotexceedingthirtythousanddollars,ortoatermofimprisonmentnotexceedingsixyears,ortobothsuchfineandtermofimprisonment.
12.
Offencesinconnectionwithinspections(1)Anypersonwho―(a)obstructsanyinspectororauthorizedofficerintheexerciseofhispowersundertheSchedule;or(b)withoutreasonableexcusefailstocomplywithanyrequirementmadebyaninspectororauthorizedofficeractinginexerciseofhispowersintheSchedule;or(c)knowinglygivesafalseanswertoanyquestionputtohimbyaninspectororauthorizedofficeractinginexerciseofhispowersintheSchedule,isguiltyofanoffenceandliableonsummaryconvictiontoafinenotexceedingfivethousanddollars,ortoatermofimprisonmentnotexceedingsixmonths,ortobothsuchfineandtermofimprisonment.

CommencementTheseRegulationsshallenterintoforceonthe1stofApril2013.

2Medicalcertification(a)Everyshipownershallensurethatpriortobeginningworkonaship,allseafarersholdavalidmedicalcertificateattestingthattheyaremedicallyfittoperformthedutiestheyaretocarryoutatsea.
(b)AvalidmedicalcertificateisacertificatethatisissuedinaccordancewithRegulationI/9oftheSTCWConvention,byamedicalpractitionerauthorisedtoissuesuchcertificatesinthecountryofissue,providedthat:-(i)thecountryinwhichthemedicalcertificateisissuesisasignatorytotheConventionortheSTCWConvention;and(ii)theformofthemedicalcertificateisincompliancewiththeILO/WHOGuidelinesonConductingPre-SeaandPeriodicMedicalFitnessExaminationsforSeafarersoranypublicationsupersedingit.
(c)StandardsA1.
2paragraphs3to10shallapplytomedicalexaminations,medicalcertificatesandthevalidityofcertificates.
(d)Incaseswhereaseafarer'smedicalcertificatehasexpiredanditisimpracticabletoobtainanother,theAdministrationmayonapplicationfromtheshipowner,permittheseafarertosailforaperiodnotexceeding3monthsbeyondthedateofexpiryofthemedicalcertificate.
(e)AmedicalpractitionercarryingoutmedicalexaminationsandissuingcertificatesonbehalfoftheSaintVincentandtheGrenadinesauthorityshallcomplyasaminimumwiththefollowingrequirements:(i)bealicensedphysician;(ii)beexperiencedingeneralandoccupationalmedicineormaritimeoccupationalmedicine;(iii)haveknowledgeofthelivingandworkingconditionson-boardships,gainedeitherthroughspecialinstructionorthroughpersonalexperienceofseafaring;(iv)befamiliarwiththeguidancecontainedinILO/WHOpublicationGuidelinesforConductingPreSeaandPeriodicMedicalFitnessexaminationsforSeafarers(ILO/WHO/D.
2/1997)oranypublicationsupersedingit;(v)remainabsolutelyprofessionallyindependentfromemployers,workersandtheirrepresentativesinexercisingtheirmedicaljudgementintermsofthemedicalexaminationprocedures;and(vi)befamiliarwiththeWorldHealthOrganizationPublication,TheInternationalMedicalGuideforShips,oranequivalentmedicalguideforuseonships.
3(a)Subjecttoparagraph(b)everyseafareremployedinaSaintVincentandtheGrenadinesshipinapositionwhichiscoveredbytheSTCWConventionTrainingandqualificationshallbetrainedandcertificatedinaccordancewiththerequirementsofthatConventionasappropriatetohisroleon-board.
(b)Seafarersshallreceivefamiliarisationtrainingandinstructionappropriatetotheirrolebeforecommencingworkon-board.
4Recruitmentandplacement(a)TheoperatorofeveryprivateseafarerrecruitmentandplacementserviceinSaintVincentandtheGrenadines,theprimarypurposeofwhichistherecruitmentandplacementofseafarersorwhichrecruitsandplacesasignificantnumberofseafarers,shallensuresuchaserviceisoperatedonlyinconformitywithalicenceissuedbytheAdministration.
(b)TheAdministrationshallestablish,modifyorchangesuchasystemoflicensingonlyafterconsultation.
Intheeventofdoubtastowhetherthisparagraphappliestoaservice,thequestionshallbedeterminedbytheAdministrationafterconsultation.
(c)Paragraphs(a)and(b),totheextentdeterminedbytheAdministrationtobeappropriateafterconsultationshallapplyalsotoanyrecruitmentandplacementservicesoperatedbyaseafarers'organisationinSaintVincentandtheGrenadinesforthesupplyofseafarerswhoarenationalsofSaintVincentandtheGrenadinestoshipswhichflyitsflag.
(d)Aservicereferredtoinparagraph(c)is;(i)onewhichisoperatedpursuanttoacollectivebargainingagreementbetweenthatorganisationandashipowner;(ii)inrelationtowhichboththeseafarers'organisationandtheshipownerarebasedinSaintVincentandtheGrenadines;and(iii)oneinwhichtheAdministrationhasauthorisedthecollectivebargainingagreementpermittingtheoperationoftherecruitmentandplacementservice.
(e)Theoperatorshallensurethataservicereferredtoinsub-paragraph(c)isoperatedinanorderlymannerandshallputinplacemeasurestoprotectandpromoteseafarers'employmentmeasurescomparabletotheprotectionprovidedbysub-paragraph(g).
(f)Anyseafarerrecruitmentandplacementserviceshallnot;(i)usemeans,mechanismsorlistsintendedtopreventordeterseafarersfromgainingemploymentforwhichtheyarequalified;or(ii)requirethatfeesorotherchargesforseafarerrecruitmentorplacementorforprovidingemploymenttoseafarersbebornedirectlyorindirectly,inwholeorinpart,bytheseafarer,otherthanthecostoftheseafarerobtaininganationalstatutorymedicalcertificate,thenationalseafarer'sbookandapassportorothersimilarpersonaltraveldocuments,notincluding,however,thecostofvisas,whichshallbebornebytheshipowner.
(g)AseafarerrecruitmentandplacementserviceinSaintVincentandtheGrenadinesshall:(i)maintainanup-to-dateregisterofallseafarersrecruitedorplacedthroughthem,tobeavailableforinspectionbytheAdministration;(ii)makesurethatseafarersareinformedoftheirrightsanddutiesundertheiremploymentagreementspriortoorintheprocessofengagementandthatproperarrangementsaremadeforseafarerstoexaminetheiremploymentagreementsbeforeandaftertheyaresignedandforthemtoreceiveacopyoftheagreements;(iii)verifythatseafarersrecruitedorplacedbythemarequalifiedandholdthedocumentsnecessaryforthejobconcerned,andthattheseafarers'employmentagreementsareinaccordancewithapplicablelawsandregulationsandanycollectivebargainingagreementthatformspartoftheemploymentagreement;(iv)makesure,asfarasispracticable,thattheshipownerhasthemeanstoprotectseafarersfrombeingstrandedinaforeignport;(v)examineandrespondtoanycomplaintconcerningtheiractivitiesandadvisethecompetentauthorityofanyunresolvedcomplaint;and(vi)establishasystemofprotection,bywayofinsuranceoranequivalentappropriatemeasure,tocompensateseafarersformonetarylossthattheymayincurasaresultofthefailureofarecruitmentandplacementserviceortherelevantshipownerundertheseafarers'employmentagreementtomeetitsobligationstothem.
(h)Itshallbethedutyofeachshipownerto:(i)AscertainthatanyseafarerrecruitmentandplacementserviceswhichheusesforrecruitmentandplacementofseafarersaboardanySaintVincentandtheGrenadinesshipthatare:(1)basedinStatesorterritoriesinwhichtheConventionappliesistheholderofavalidlicence,certificate,orotherdocument,issuedbythecompetentauthorityinsuchotherStatesorterritoriestoevidencecompliancewithStandardA.

(b)Exceptasprovidedinsub-paragraph(i),everyseafarershallbeentitledtominimumhoursofrestofnotlessthan;(i)tenhoursinany24-hourperiod;and(ii)77hoursinanyseven-dayperiod.
(c)Hoursofrestmaybedividedintonomorethantwoperiods,oneofwhichshallbeatleastsixhoursinlength,andtheintervalbetweenconsecutiveperiodsofrestshallnotexceed14hours.
(d)Timewhenaseafarerisoncallmayberegardedasresttimeprovidedthatheisnotcalledtoworkduringthattimeandifheiscalledtoworkduringthetimeoncallheshallbeprovidedwithadequatecompensatoryrest.
(e)Musters,lifeboatdrills,securitydrillsandotherdrillsandtrainingexercisesrequiredbySaintVincentandtheGrenadineslawsandbytheapplicablemaritimeconventionsshallbearrangedinsuchamannerastominimisethedisturbancetohoursofrestandtoavoidfatigue.
(f)Therequirementsinsub-paragraphs(b)and(c)neednotbecompliedwithinacaseofemergencyorotheroverridingoperationalconditionprovidedthatonconclusionofthesituationtheseafarersinvolvedreceivesuitablecompensatoryrestsothatfatigueisavoided.
(g)TheAdministrationmay,afterconsultation,agreeandapproveacollectivebargainingagreementthatvariesfromthestandardsinparagraphs(b)and(c)toallowformorefrequentorlongerleaveperiods,orthegrantofcompensatoryleaveforseafarersworkingon-boardshipsonshortvoyagesprovidedthattheagreementfollowstheintentofthestandard.
(h)Seafarerswhoareengagedaswatchkeepingofficersorasratingsformingpartofawatchorwhosedutiesinvolvedesignatedsafety,preventionofpollution,orsecuritydutiesmaybeexemptedfromtherequirementsofsub-paragraph(c)providedthat:(i)theyreceivenotlessthan70hoursrestinany7dayperiod,(ii)anyexceptionshallnotpersistformorethantwoconsecutiveweeks,and(iii)theperiodbetweenanytwoperiodsofexceptionisnotlessthantheperiodofexception.
(i)Seafarerswhoareengagedaswatchkeepingofficersorasratingsformingpartofawatchorwhosedutiesinvolvedesignatedsafety,preventionofpollution,orsecuritydutiesmayexceptionallyhavethehoursofrestinsub-paragraph(b)dividedintomorethantwoperiods,butnomorethan3periods,providedthat;(i)oneperiodisatleast6hoursinlengthandtheothertwoarenotlessthan1hour,(ii)theintervalsbetweenconsecutiveperiodsofrestarenotmorethan14hours,and(iii)anyexceptionunderthisparagraphdoesnotextendbeyondtwo24hourperiodsinany7dayperiod.
(j)Nothinginsub-paragraphs(b),(c),(h),or(i)shallbedeemedtoimpairtherightofthemasterofashiptorequireaseafarertoperformanyhoursofworknecessaryfortheimmediatesafetyoftheship,personson-boardorcargo,orforthepurposeofgivingassistancetoothershipsorpersonsindistressatseaandthemastermaysuspendthescheduleofhoursofworkorhoursofrestandrequireaseafarertoperformanyhoursofworknecessaryuntilthenormalsituationhasbeenrestored.
Assoonaspracticableafterthenormalsituationhasbeenrestored,themastershallensurethatanyseafarerswhohaveperformedworkinascheduledrestperiodareprovidedwithanadequateperiodofrest.

(n)Recordsinelectronicformatmaybeacceptedasmeetingtherequirementsinsub-paragraphs(l)and(m)providedthat:(i)eachseafarerhasreadyaccesstohisrecords,(ii)eachseafarercanobtainaprintedcopyatanyreasonabletime,(iii)therecordsareelectronicallyendorsedbytheseafarerandthemasterorapersonauthorised,(iv)therecords,onceendorsed,areprotectedagainsttamperingandareaccessibletoPortStateControlofficersandtoSaintVincentandtheGrenadinesinspectorsandauthorizedofficers,(v)therecordsareavailableon-boardforaperiodofatleast3years,and(vi)therecordsareinaformatrecognisablysimilartotheformatintheIMO/ILOGuidelines.

9Repatriation(a)EveryshipsubjecttotheseRegulationsshallhavefinancialsecuritywhichcoversthecostofrepatriationofseafarersinaccordancewiththeseRegulations.
(b)Seafarersareentitledtorepatriationatnocosttothemselves:-(i)whentheseafarer'semploymentagreementexpireswhiletheseafarerisabroad,(ii)whentheseafarer'semploymentagreementisterminatedbytheemployerinaccordancewithitsterms,(iii)whentheseafarer'semploymentagreementisterminatedbytheseafarerforjustifiedreasons,(iv)intheeventofillnessorinjuryorothermedicalconditionwhichrequirestheirrepatriationwhenfoundmedicallyfittotravel,(v)intheeventofshipwreck,(vi)intheeventoftheshipownernotbeingabletocontinuetofulfillhislegalorcontractualobligationsasanemployeroftheseafarersbyreasonofinsolvency,saleofship,changeofship'sregistrationoranyothersimilarreason,and(vii)intheeventofashipbeingboundforawarzone,asdefinedbynationallawsorregulationsorseafarers'employmentagreements,towhichtheseafarerdoesnotconsenttogo.
(c)Themaximumdurationofserviceperiodson-boardfollowingwhichaseafarerisentitledtorepatriationinaccordancewithsub-paragraph(b)(iii)shallbespecifiedinhisemploymentagreement,butineverycaseshallnotexceed12months.
(d)Thecoststobebornebyashipownerforrepatriationundersub-paragraph(b)shallincludethefollowing;(i)passagetotherepatriationdestination,(ii)accommodationandfoodfromthemomenttheseafarerleavestheshipuntilhereachestherepatriationdestination,(iii)payandallowancesfromthemomenttheseafarerleavestheshipuntilhereachestherepatriationdestination,(iv)transportationof30kgoftheseafarer'spersonalluggagetotherepatriationdestination;and(v)medicaltreatmentwhennecessaryuntiltheseafarerismedicallyfittotraveltotherepatriationdestination.
(e)Therepatriationdestinationshallbetheplacewheretheseafarerwasrecruitedunlesstheemploymentagreementspecifiesotherwiseortheseafarerandtheshipowneragreeanalternativeandthemodeoftransporttothatdestinationshallnormallybebyair.
(f)Seafarersshallnotberequiredtomakeanycontributiontowardsthecostofrepatriationatthecommencementof,orinadvanceof,theiremploymentandthecostsofrepatriationshallnotberecoveredfromaseafarer'swagesorotherentitlementsexceptinacasewheretheseafarerisfoundtohavebeeninseriousdefaultofhisemploymentobligations.
(g)NothingintheseRegulationsshallprejudicetherightofashipownertorecoverthecostofrepatriationunderthirdpartycontractualarrangements.
(h)Ifashipownerfailstomakearrangementsfor,ortomeetthecostofrepatriationofseafarersservinginaSaintVincentandtheGrenadinesshipwhoareentitledtoberepatriated-(i)TheAdministrationshallarrangefortherepatriationoftheseafarersinvolved;and(ii)CostsincurredbytheAdministrationinmeetingthisobligationshallberecoverablefromtheshipowner;(i)Theexpenseofrepatriationshallinnocasebeachargeuponseafarersexceptasprovidedinsub-paragraph(f).
(j)Therightofrepatriationinaccordancewiththeseregulationsshallnotberefusedbecauseofthefinancialcircumstancesofashipownerorbecauseofashipowner'sinabilityorunwillingnesstoreplaceaseafarer.
(k)IftheAdministrationhasrepatriatedaseafarerpursuanttosub-paragraph(h),andcostsincurredhavenotbeenrecovered,itmayarresttheshipuntilsuchcostsarereimbursed,subjecttoanyprovisionsintheActrelatingtoarrestofships.
(l)Wherethedetailsofrequirementsgoverningrepatriationarenotsetoutexactlyintheseafarer'semploymentagreement,eachseafarershallhaveaccessatanytimeandinanappropriatelanguage,totheSaintVincentandtheGrenadinesprovisionsintheseRegulations.
10Seafarer'scompensation(a)Inthecaseoflossorfounderingofaship,theshipownershallindemnifyeachoftheseafarerson-boardagainsttheunemploymentcausedbytheloss,atthebasicrateofthewageshewouldhaveearneduptoamaximumoftwomonthswages.
(b)Nothinginsub-paragraph(a)shallprejudiceanyotherrightsaseafarermayhaveforlossesorinjuriesarisingfromaship'slossorfoundering.
11Manning(a)Allshipsshallhaveasufficientnumberofseafarerson-boardintheappropriatepositionstoensurethattheyareoperatedsafely,efficientlyandwithdueregardtosecurityunderallconditions.
(b)Ashipshallbedeemedtobemannedbyacrewthatisadequate,intermsofsizeandqualificationswhenitismannedinaccordancewiththeSafeManningDocumentissuedbytheAdministration.

(g)TheAdministrationmay,afterconsultation,exemptshipsoflessthan200grosstonsfromtherequirementsinsub-paragraphs(b)and(c),inaccordancewithStandardA3.

13Foodandcatering(a)Shipsshallcarryon-boardandservefoodanddrinkingwater,havingregardtothenumberofseafarerson-boardandthedurationofthevoyage,ofappropriatequality,nutritionalvalue,varietyandquantitythatadequatelycoverstherequirementsoftheshipandtakesintoaccountdifferingculturalandreligiousbackgrounds.
(b)Foodanddrinkingwaterprovidedtoseafarersduringtheirengagementon-boardshallbeatnochargetotheseafarers.
(c)Shipownersshallensurethattheorganisationofthecateringdepartmentandtheequipmentprovidedissuchthatadequate,varied,andnutritiousmealsarepreparedandservedinhygienicconditions.
(d)Ship'soperatingwithamanninglevelof10personsormoreshallcarryacompetentandqualifiedshipscook.
(e)Acookshallbequalifiedifheis18yearsofageormoreandhe:(i)Istheholderofavalidcertificateissuedby;(1)anorganizationapprovedorrecognizedbytheAdministration;(2)aStatewhichispartytotheConventionortotheCertificationofShipsCooksConvention,1946(No.
69);(ii)shallhaveservedatseafor3monthsassecondcook/cookassistantor5yearsinthecateringdepartmentassteward.
Inbothcaseshe/sheshallhavereceivedtraininginhandlingfoods,storageoffoodson-boardshipsandhygieneinthegalleyfoodpreparationareas;or(iii)possessesapprovedqualificationsincookeryvalidinacommercialcookingestablishment.
(f)Approvedinsub-paragraph(e)(iii)meansapprovedbytheAdministrationorbythecompetentauthorityofanotherStatepartytotheConvention.
(g)Onashipoperatingwithaprescribedmanningoflessthantenandwhichdoesnotcarryacooktheshipownershallensurethatanyoneprocessingfoodinthegalleyistrainedorinstructedinareasincludingfoodandpersonalhygieneaswellashandlingandstorageoffoodon-boardship.
(h)Inanycasewhereduetoexceptionalcircumstancesaqualifiedcookisnotavailable,orhasbeenrequiredtoleaveashipinwhichaqualifiedcookisrequired,theAdministrationmayissueadispensationpermittinganotherpersontoserveascookforaperiodnotexceedingonemonthoruntilthenextsuitableportwhicheveroccursfirstprovidedthatthepersontakingontheroleofcookhasreceivedinstructionortraininginfoodandpersonalhygieneandthehandlingandstorageoffoodon-board.
(i)ThemasterofeverySaintVincentandtheGrenadinesshipshallensurethatweeklyinspectionsarecarriedoutof:(i)suppliesoffoodanddrinkingwater,(ii)spacesandequipmentusedforthestorageandhandlingoffoodanddrinkingwater,and(iii)galleysandotherequipmentforthepreparationandserviceofmeals.

(d)Theshipownershallnotbeliabletopaywagesundersub-paragraph(b)inrespectofaseafarernolongeron-boardforaperiodlongerthan16weeksfromthedayoftheinjuryorthecommencementofthesickness.
(e)Theshipownerisnotliableundersub-paragraphs(b)or(c)inrespectof:(i)injuriesincurredotherwisethanintheserviceoftheship;(ii)injuryorsicknessduetothewilfulmisconductofthesick,injuredordeceasedseafarer;and(iii)sicknessorinfirmityintentionallyconcealedwhentheengagementisenteredinto.
(f)Theshipownerisnotliablefortheexpenseofmedicalcareandboardandlodgingandburialexpensesinsofarassuchliabilityisassumedbyanypublicauthority.
(g)Shipownersshalltakemeasuresforsafeguardingpropertylefton-boardbysick,injuredordeceasedseafarersandshallbeliableforthereasonablecostsofreturningittothemortotheirnextofkin.
16Healthandsafetyprotection(a)Everyshipownershallputinplacemeasuresintendedtoensurethehealthandsafetyofseafarersandtheprovisionofaworkingenvironmenton-boardanyshipforwhichtheyareresponsibleinwhichtheoccupationalhealthofseafarersisprotectedandwhichissafe,cleanandhygienic.
(b)Withoutprejudicetothegeneralityoftheshipowner'sdutyundersub-paragraph(a),thematterstowhichthatdutyextendsshallincludeinparticularandsofarasispracticable–(i)theprovisionandmaintenanceofplant,machineryandequipment,andsystemsofworkthataresafeandwithoutrisktohealth;(ii)arrangementsforensuringsafetyandabsenceofrisktohealthinconnectionwiththeuse,handling,stowageandtransportofarticlesandsubstances;(iii)theprovisiontotheseafarersofsuchinformation,instruction,trainingandsupervisionasisnecessarytoensurethehealthandsafetyofpersonsaboardship;(iv)themaintenanceofallplacesofworkintheshipinaconditionthatissafeandwithoutrisktohealth;and,(v)theprovisionandmaintenanceofanenvironmentaboardshipthatissafeandwithoutrisktohealth.
(c)Itshallbethedutyofeveryshipownertoprepareand,asoftenasmaybeappropriate,reviseawrittenstatementofhisgeneralpolicywithrespecttothehealthandsafetyaboardshipandthearrangementsforthetimebeinginforceforcarryingoutthatpolicy,andtobringthestatementandanyrevisionofittothenoticeofseafarers.
(d)ForshipsregisteredinSaintVincentandtheGrenadinesthestandardsandpracticesrequiredforoccupationalhealth,riskanalysis,safeworkingpracticesandmeasurestoreducetheriskofexposuretoharmfullevelsofambientfactorsandchemicalsandtheriskofinjuryordiseaseshallbethosesetoutin:-(i)TheILOCode–Accidentpreventionon-boardshipsatseaandinport1996,and(ii)SuchotherguidanceastheAdministrationmaypublishfromtimetotime.
(e)EverySaintVincentandtheGrenadinesshipshallcarryon-boardanuptodatecopyoftheILOCode–AccidentPreventionon-boardShipsatSeaandinPortwhichmaybeinpaperorelectronicformatprovidedthatalltheseafarershaveaccessatanytimetoitscontentappropriatetotheirroleson-board.
(f)Noshipownershalllevyorpermittobeleviedonanyseafareranychargeinrespectofanythingdoneinpursuanceofsub-paragraphs(b)or(d).
(g)Allaccidents,injuriesanddiseasesoccurringon-boardanySaintVincentandtheGrenadinesshipshallbereportedtotheAdministrationattheearliestpossibleopportunityfollowingtheoccurrenceinaccordancewithrequirementspublishedbytheAdministration.
(h)IneverySaintVincentandtheGrenadinesshipinwhichtherearefiveormoreseafarerstheshipownershallarrangeforaSafetyCommitteetobeestablished.
TheSafetyCommitteeshallincluderepresentativesfromalldepartmentson-board.

(f)WithoutprejudicetoPartXVIIIoftheAct(EnforcementOfficersandPowers),theappointmentofinspectorsfortheverificationthatthemeasuresrelatingtoworkingandlivingconditionsassetoutinthedeclarationofmaritimelabourcompliance,whereapplicable,arebeingfollowed,andthattherequirementsoftheConventionaremet,andtheconductofsuchinspections,shallbeinaccordancewithStandardA5.

19Complaints(a)NopersonshallvictimiseanyseafarerforfilingacomplaintandvictimisationshallbeanoffencesubjecttothepenaltiesspecifiedinRegulation10oftheseregulations.
(b)Everyshipownershalldevelopaformalcomplaintsprocedurethatisavailabletoalltheseafarerson-boardshipsforwhichheisresponsible.
Theprocedureshall;(i)seektoresolvecomplaintsatthelowestlevelpossiblebutshallnotpreventaseafarerfrommakingacomplaintdirectlytotheship'smaster,shipowner,theAdministrationortothecompetentauthorityintheseafarer'scountryofresidence,wheretheseafarerconsidersitnecessaryorappropriate,(ii)providefortheseafarermakingacomplainttohavetherighttobeaccompaniedorrepresentedduringtheprocedure,(iii)includesafeguardsagainstvictimisationofanyseafarermakingacomplaintwherevictimisationincludesanyadverseactiontakenagainstaseafarerbyanypersonfollowingacomplaintwhichisnotmaliciousorvexatious.
(c)Notwithstandingthegeneralstandardsinsub-paragraph(b)acomplaintsprocedureshallensurethat:(i)Complaintsareaddressedtotheheadofthedepartmentinwhichtheseafarerworksortohissuperiorofficer,(ii)Resolutionisattemptedbytheheadofdepartmentorthesuperiorofficerwithinsevendays,(iii)Whenresolutionbytheheadofdepartmentorthesuperiorofficerisnotsuccessfultheseafarercantakethemattertothemasterwhoshalldealwithitwithinaperiodofsevendays,(iv)Anyseafarermakingacomplaintisallowedtobeaccompaniedandtoberepresentedbyanotherseafareroftheirchoiceon-boardtheship,(v)Allcomplaintsandthedecisionsmadearerecordedandacopyoftherecordismadeavailabletotheseafarerconcerned,(vi)Whenacomplaintcannotberesolvedon-boardtheseafarerthenhastendaystorefertotheshipownerorhisrepresentativeashore,throughtheMaster,whoshallresolvethematterwithinthirtydays,(vii)theshipownerorhisrepresentativeandtheseafarershallhaveaperiodofthirtydaystoresolvethematter,(viii)ifthereafterthematterisnotresolved,eitherpartymaywithinthirtydaysbringthemattertotheAdministrationforresolution.
(d)Everyseafarershallbeprovidedwithacopyoftheon-boardcomplaintsprocedureputinplacebytheshipownerandwiththeAdministration'scontactinformationandcontactinformationforthemaritimeauthoritiesintheseafarer'scountryofresidence.
(e)Everyseafarershallbeprovided,inadditiontothecomplaintsprocedure,withthenameofthepersonorpersonson-boardwhocan,onaconfidentialbasis,providethemwithimpartialadviceonacomplaintorotherwiseassistthem.
(f)InaccordancewithArticleVIoftheConventiontheAdministrationacceptsasasubstantialequivalent,provisionoftheidentityofapositionon-boardasmeetingtherequirementsofsub-paragraph(e).
20Portstatecontrol(a)EveryshipwhichisnotaSaintVincentandtheGrenadinesshipcalling,inthenormalcourseofitsbusinessorforoperationalreasons,inaportinSaintVincentandtheGrenadinesmaybethesubjectofinspectionforthepurposeofreviewingcompliancewiththerequirementsoftheConvention(includingseafarers'rights)relatingtotheworkingandlivingconditionsofseafarersontheship.
(b)Inspectionsundersub-paragraph(a)shallbecarriedoutbyauthorisedofficers.

Withregardtothelevelofmedicaltrainingtobeprovidedon-boardshipsthatarenotrequiredtocarryamedicaldoctor:(a)shipswhichordinarilyarecapableofreachingqualifiedmedicalcareandmedicalfacilitieswithineighthoursshallhaveatleastonedesignatedseafarerwiththeapprovedmedicalfirst-aidtrainingrequiredbySTCWConventionwhichwillenablesuchpersonstotakeimmediate,effectiveactionincaseofaccidentsorillnesseslikelytooccuron-boardashipandtomakeuseofmedicaladvicebyradioorsatellitecommunication;and(b)allothershipsshallhaveatleastonedesignatedseafarerwithapprovedtraininginmedicalcarerequiredbySTCWConvention,includingpracticaltrainingandtraininginlife-savingtechniquessuchasintravenoustherapy,whichwillenablethepersonsconcernedtoparticipateeffectivelyincoordinatedschemesformedicalassistancetoshipsatsea,andtoprovidethesickorinjuredwithasatisfactorystandardofmedicalcareduringtheperiodtheyarelikelytoremainon-board.

1第4款以及第MLC002号通函-第1次修订版所附DMLC第I部分第12.
3款之要求,本通函特提供有关圣文森特和格林纳丁斯旗船舶的船上医疗指南.
本通函应与第ILO001号通函配合使用.
医药箱、医疗设备与医疗用品2.
船舶应持续符合第ILO001号通函-第1次修订版的要求.
医疗培训3.
关于在不要求配备医生的船舶上应提供的医疗培训水平:(a)对于通常能够在8小时内获得合格的医疗和医疗设施的船舶,其至少应配备一名接受过《STCW公约》所要求的经认可的医疗急救培训的指定海员,使其能够在船上可能发生事故或出现疾病时,立即采取有效行动和采用通过无线电或卫星通信获得的医疗建议;以及(b)所有其它船舶应至少配备一名接受过《STCW公约》所要求的经认可的医疗培训的指定海员,包括实践培训以及诸如静脉治疗等抢救技能的培训,以使相关人员能有效参与船舶海上医疗援助协调活动,并在病号或伤员可能在船上停留的期间内向他们提供符合标准的医疗.

本附则第2款所述的培训应基于以下文件最新版本的内容:《国际船舶医疗指南》、《危险品事故专用医疗急救指南》、《指导文件—国际海事培训指南》,以及《国际信号规则》的医疗部分.
