WHATISCOVEREDThisWarrantyisprovidedbyBigAssFansof2348InnovationDrive,Lexington,KY,USA,andcoversanydefectsinmaterialsorworkmanshipundernormaluseandmaintenancethatadverselyaffecttheabilityofthefantooperateproperlywhentheproductisinstalledcorrectlyaccordingtoBigAssFans'writteninstallationinstructionsbyastate-qualifiedorlicensedelectricalcontractorandoperatedpursuanttotheseinstructions,andwhensuchfansarepurchaseddirectlyfromBigAssFansoraBigAssFansAuthorizedDealer.
ThisLimitedWarrantyissubjecttoallprovisions,conditions,limitations,andexclusionsdescribedwithinthisdocument.
UndernocircumstanceswillwarrantycoverageextendtoproductspurchasedthrougheBay,craigslist,orotherinternetauctionorinternet-basedretailsitesnotapprovedbyBigAssFans.
WHOISCOVEREDThisWarrantyextendstotheoriginalpurchaserandsubsequentowners,butonlywhilethefanremainsatthesiteoftheoriginalinstallation.
ThisWarrantyextendsthroughthefirstinstallationofthefanandterminatesifthefanismovedorreinstalledatanewlocation.
ThisWarrantyisvalidforproductsinstalledoutsideofthe50statesoftheUnitedStatesandDistrictofColombia,the10CanadianProvincesandTerritories,Australia,Singapore,andMalaysia.
WHATWILLBIGASSFANSDODuringtheWarrantyPeriod,BigAssFanswill,atitsoptionandcost:1.
Repairorreplacetheaffectedcomponentsofanydefectiveproduct;2.
Repairorreplacethedefectiveproduct;or3.
RefundthepriceyoupaidfortheproductuponreturnoftheproducttoBigAssFans,shippingandinsuranceprepaid.

TheforegoingconstitutesyourexclusiveremedyandthelimitofliabilityforBigAssFans,andforanyandalllossesinconnectionwiththisproduct.
WHATSTEPSAREREQUIREDTOOBTAINWARRANTYSERVICE1.
Ifthefanisoperating,immediatelyturnoffthefan.

ContactBigAssFans'TechnicalSupportassoonaftertheissueisdiscoveredaspossibleby:a.
VisitingtheBigAssFanswebsiteandsubmittingatechnicalsupportform;orb.
CallingtheTechnicalSupportphonenumberlistedforyourregion.

OncetheTechnicalSupportRepresentativehasreceivedyourwarrantyclaim,acasewillbeprocessed.
Inordertoprocessthiscase,pleasehavethefollowinginformationavailable:a.
Yourname,address,phonenumber,andinstallationaddress;b.
Productbrandname,serialnumber,purchaseprice,andverificationofproductinstallationorpremisespossessiondate;c.
Detaileddescriptionoftheproblemyouhaveexperienced.

IftheTechnicalSupportRepresentativedeterminesthatthewarrantyclaimisvalidandthatareplacementpartisrequired,theRepresentativewillprocesstheclaimandthereplacementpartwillbeshippedtoyou.
Includedintheshipmentofthereplacementpartwillbeanyshippinglabelsanddocumentsneededtoreturntheoriginalpart,includingaReturnMaterialsAuthorization(RMA)number.
Youwillberesponsibleforpayingalldutiesandtaxesonshipments.
BigAssFansmayreimburseforreasonabledutiesandtaxesthatyoupay.
YourreceiptofthereplacementpartconstitutesyouragreementtoreturnthefailedparttoBigAssFanswithin15daysofthereceiptofthereplacementpartdelivery.
IfBigAssFansdoesnotreceivetheoriginalpart,youwillbeinvoicedfortheretailcostofthereplacementpart,andyouwillberesponsibleforpaymentforthereplacementpartuponreceiptoftheinvoice.
BigAssFansreservesallrightsitretainsunderlawtocollecttheretailcostofthereplacementpartiftheoriginalisnotreturnedasspecifiedabove.
5.
Obtainingservicemayinvolvecontactingacontractortoremove,repair,orreplacethefan,ortoremovethefanandreturnittous.
6.
IfweaskyoutoshipthefanbacktoBigAssFansforrepairsorreplacement,wewillprepaytheshippingandinsuranceforfactoryinstalledfansduringthefirst12monthsafterthewarrantybecomeseffective;however,youwillhavetorepackagethefaninsuchawaythatthereisnodamagetothefanintransit.
YouwillbesentanyreturnshipmentdocumentationnecessarytohelpyoureturnthefantoBigAssFans.
Ifwedeterminethatnowarrantablefailureoccurredordefectexists,wemayinvoiceyoufortheseshippingcosts.
Pleasebepatientwhilewearrangefororundertakethenecessarywarrantyservice.
Wewillprovideyouwithregularstatusupdates,aswellasshipmentdates,ifappropriate,untilyourfanisbackinservice.
CONDITIONS1.
BigAssFansreservestherighttomakethefinaldetermination,basedonitsownevaluationofthefanandallitscomponents,astowhether:a.
Theprobleminquestionistheresultofadefectindesign,workmanship,ormaterials,andnotaresultoferror,misuse,orabuseonthepartofthecustomerassetforthundertheexclusionsdetailedinthisWarranty;b.
Noiseheardduringoperationiswithinnormaloperatinglevels,inwhichcasethisWarrantywouldbeinapplicable.
Note:Certainelectrical,motor,orotheroperatingnoisemaybeimpossibletoeliminateduetothefandesignand/orsiteconditions.
DissatisfactionwithnormaloperatingnoiselevelsisnotcoveredbythisWarranty,andreturnofanyfansforthisreasonwillbesubjecttoBigAssFans'ReturnPolicy.

Adversesiteconditions,(including,butnotlimitedto,excessivedust,heat,humidity,unstableelectricservice,oranyotherunknownorunforeseenconditionthataffectstheproperoperationoftheproducts)improperapplication,orimproperinstallationisdeterminedtobethebasisforthefailure.
d.
TheproblemordefectismaterialandrequiresactionunderthisWarranty;ande.
Theremedyofrepair,replacement,orrefundisappropriate.

IfBigAssFansdetermines,initssolediscretion,thattheappropriateremedyundertheWarrantyisarefund,therefundamountwillbelimitedtothepricepaidbythecustomerfortheproductalone,andundernocircumstanceswillitincludethecostoflabor,shipping,handling,packaging,oranyotherincidentalorconsequentialcostsincurredoranticipatedbythecustomer.

Withrespecttoreplacementorrepairrendered,BigAssFansreservestherighttousereplacementpartsthatarerefurbished.
BigAssFanswarrantsthatthepartsreplacedorrepaired,whetherornottheyhavebeenrefurbishedorareoriginalequipment,willoperateproperlyandbefreefromdefectsinmaterialsandworkmanshipforaperiodof90daysfromthedateofshipmenttothecustomer,orfortheremainderoftheoriginalwarrantyperiod,whicheverislonger4.
Aservicefee,partsreplacementfee,andshippingchargesmaybeimposedifanyfanisreturnedforwarrantyservicethatismissingcomponentsorthathasbeenmodifiedinanyway.
Suchfeesandchargeswillvarybasedupontheactualmaterialandlaborcostsnecessarytoreplacemissingormodifiedpartsandtoreturnthefantoitsoriginalfactorycondition.
WHATISNOTCOVERED(EXCLUSIONS)Nootherwrittenororalwarrantiesapply,andnoemployee,agent,dealer,orotherpersonisauthorizedtogiveanywarrantiesonbehalfofBigAssFans.
ATTENTION:UndernocircumstanceswillBigAssFansberesponsibleforremedialworknecessarytocorrectinstallationproceduresbyothersthatdonotconformtothoseestablishedbytheinstructions,codes,andstandardsdescribedunderitems2through3dbelow.

Defects,malfunctions,failureorphysicaldamagecausedbyunauthorizedservice/partsandimproperinstallation,adversesiteconditions(including,butnotlimitedto,excessiveheat,dustorhumidity,unstableelectricservice,oranyotherunknownorunforeseenconditionthataffectstheproperoperationoftheproducts),mishandling,modifications,ordamagewhileinyourpossessionincludingfailuretoprovidereasonableandnecessarymaintenance,whichshallinclude,butnotbelimitedto:a.
FailuretofollowtherequiredinstallationproceduresspecifiedintheBigAssFans-suppliedinstallationinstructionsandinallotherdocumentationsuppliedwiththefansandrelatedequipment;b.
Failuretofollowallrelevantcodesandordinancesincluding,butnotlimitedto,anyapplicableelectriccodesorsimilarcodesandotherjurisdictional(includingprovincesandlocalities)localbuildingcodes;c.
Failuretofollowelectricalengineeringindustrystandardsregardingtheapprovedmethodofinstallingsolid-stateelectricalequipmenthavingthecharacteristicsofthefan,thefancontrol,andtheirrelatedcomponents,evenifsuchstandardsarenotspecificallyreferencedinanyinstructionsorliteraturesuppliedbyBigAssFans;d.
FailuretouseproperlyallinstallationandmountinghardwaresuppliedorapprovedbyBigAssFans;e.
Anymodificationoralterationof,oradjustmenttothefans,fancontrol,and/ormountingandinstallationhardwareand/oranydisassemblyofthemajorcomponentsofthefansandfancontrolsforanypurposewhatsoever,includinganyattempttodiagnoseand/orrepairanyproblem,withoutpriorwrittenauthorizationfromBigAssFans'TechnicalSupportDepartment;f.
Misuse,abuse,accidents,unreasonableuse,orActsofGod;g.
Incorrectelectriccurrent,voltage,orsupply;h.
FailuretousefancontrolssuppliedbyBigAssFansunless:i.
BigAssFans'TechnicalSupportDepartmenthasprovidedwrittenpermissionpriortoinstallation;andii.
Thefancontrolsarebuilt,operated,andmaintainedaccordingtospecificationsprovidedtoandapprovedbyBigAssFans'TechnicalSupportDepartment.
i.
FailuretoperformperiodicmaintenanceasdetailedintheinstructionssuppliedwiththefanandprovidedontheBigAssFanswebsite.
BigAssFansrecommendsexaminingtheceilingfansuspensionsystematleastonceeverytwoyears.
4.
Consequentialorincidentaldamagessustainedbyanyperson,entity,orstructureasaresultofanybreachofthesewarranties,exceptwheresuchdamagesmaynotbeexcludedbylaw.
5.
Claimsmadeforproductsthathavenotbeenpaidforinfull.
6.
Damagecausedbypremisesstructuraldefects,structuralmovementorsettlement,exposuretochemicals,saltwater,acidrainorothercorrosiveelements,excessivehumidity,and/orwind.
7.
Normalchangestothefinishcausedbyordinaryuseordamagetonon-factoryappliedfinishes.
8.
Damageorfailurecausedbysubjectionoftheproducttoconditionsoutsideitsdesignlimitations.
9.
Defectsreportedmorethan90daysfromwhentheywerediscoveredorshouldhavebeendiscovered.
10.
WithregardtoelectricalandelectroniccomponentsprovidedbyBigAssFansthatcomprisepartoftheproducts,includingmotors,motordrives,andvariablefrequencydrives,BigAssFansreliesonthedeterminationbytheoriginalmanufacturerastowhetherthefailureofsuchcomponentwastheresultofadefect.
Ifthemanufacturerofsuchcomponentdeterminesthattherewasnodefectandthereforerefusestocoveritunderwarranty,BigAssFanslikewisewillnotwarrantysuchitemunlessBigAssFansdeterminesthatthefailureofsuchelectricalorelectroniccomponentwastheresultofadefectofdesign,workmanship,ormaterialwithinsomeotherpartoftheproducts.
REPAIR,REPLACEMENT,ORAREFUNDARETHEEXCLUSIVEREMEDIESAVAILABLEUNDERTHISWARRANTYANDBIGASSFANSISNOTRESPONSIBLEFORDAMAGESOFANYKIND,INCLUDINGINCIDENTALANDCONSEQUENTIALDAMAGES.
Incidentaldamagesincludebutarenotlimitedtosuchdamagesaslossoftimeandlossofuse.
Consequentialdamagesincludebutarenotlimitedtothecostofrepairingorreplacingotherpropertywhichwasdamagedifthisproductdoesnotworkproperly.
DEFINITIONS"Operateproperly"appliestomechanical,electrical,andstructuralfunctionsonly.
Noguarantee,unlessandexceptbyseparatewrittenagreement,ismaderegardingthedimensionsorairmovementgeneratedortheappropriatenessoftheeffectivenessofanyproductforitsintendedpurposeorforthecustomer'sparticularapplication.
BigAssFansdoesnotwarrantorguaranteeionlevelsnortheeliminationofanyparticularpathogensormicrobeswheniontechnologyisincorporatedintothefansystem,asoperatingconditionsareoutsideofourcontrol.
ADDITIONALRIGHTSThebenefitsgiventoyouunderthisWarrantyareinadditiontoanddonotaffectanyotherrightsorremediesthatyouhaveunderanylawwhichrelatestothisproduct.

NOOTHERWARRANTYEXPRESSEDORIMPLIED,WHETHEROFFITNESSFORAPARTICULARPURPOSEOROFMERCHANTABILITYOROFANYOTHERKIND,WHETHERORNOTSIMILARINNATURETOANYPREVIOUSLYSPECIFIED,SHALLEXISTWITHRESPECTTOSUCHPRODUCTS,ALLSUCHWARRANTIESBEINGHEREBYEXPRESSLYDISCLAIMEDBYBIGASSFANSANDWAIVEDBYCUSTOMER.
UNDERNOCIRCUMSTANCESSHALLBIGASSFANSBELIABLEFORANYLOSS,DAMAGE,COSTOFREPAIR,ORINCIDENTALORCONSEQUENTIALDAMAGESOFANYKINDINCONNECTIONWITHTHEUSE,SALE,ORREPAIROFANYPRODUCTSPURCHASEDFROMBIGASSFANS,UNLESSSUCHDAMAGESCANNOTBEEXCLUDEDBYLAW.
BigAssFansreservestherighttochangethiswarrantyatanytimewithoutadvancenotice.
