ARTICLEIENDANGEREDSPECIESARTICLEII(4)(07/83)RST/TREATY(07/83)CONVENTIONONINTERNATIONALTRADEINENDANGEREDSPECIESOFWILDFAUNAANDFLORATheContractingStates,RECOGNIZINGthatwildfaunaandfloraintheirmanybeautifulandvariedformsareanirreplaceablepartofthenaturalsystemsoftheearthwhichmustbeprotectedforthisandthegenerationstocome;CONSCIOUSoftheever-growingvalueofwildfaunaandflorafromaesthetic,scientific,cultural,recreationalandeconomicpointsofview;RECOGNIZINGthatpeoplesandStatesareandshouldbethebestprotectorsoftheirownwildfaunaandflora;RECOGNIZING,inaddition,thatinternationalcooperationisessentialfortheprotectionofcertainspeciesofwildfaunaandfloraagainstover-exploitationthroughinternationaltrade;CONVINCEDoftheurgencyoftakingappropriatemeasurestothisend;HAVEAGREEDasfollows:ARTICLEIDEFINITIONSForthepurposeofthepresentConvention,unlessthecontextotherwiserequires:(a)"Species"meansanyspecies,subspecies,orgeographicallyseparatepopulationthereof;(b)"Specimen"means:(i)anyanimalorplant,whetheraliveordead;(ii)inthecaseofananimal:forspeciesincludedinAppendicesIandII,anyreadilyrecognizablepartorderivativethereof;andforspeciesincludedinAppendixIII,anyreadilyrecognizablepartorderivativethereofspecifiedinAppendicesIIIinrelationtothespecies;and(iii)inthecaseofaplant:forspeciesincludedinAppendixI,anyreadilyrecognizablepartorderivativethereof;andforspeciesincludedinAppendicesIIandIII,anyreadilyrecognizablepartorderivativethereofspecifiedinAppendicesIIandIIIinrelationtothespecies;(c)"Trade"meansexport,re-export,importandintroductionfromthesea;(d)"Re-export"meansexportofanyspecimenthathaspreviouslybeenimported;(e)"Introductionfromthesea"meanstransportationintoaStateofspecimensofanyspecieswhichweretakeninthemarineenvironmentnotunderthejurisdictionofanyState;(f)"ScientificAuthority"meansanationalscientificauthoritydesignatedinaccordancewithArticleIX;(g)"ManagementAuthority"meansanationalmanagementauthoritydesignatedinaccordancewithArticleIX;(h)"Party"meansaStateforwhichthepresentConventionhasenteredintoforce.
ARTICLEIIFUNDAMENTALPRINCIPLES1.
AppendixIshallincludeallspeciesthreatenedwithextinctionwhichareormaybeaffectedbytrade.
Tradeinspecimensofthesespeciesmustbesubjecttoparticularlystrictregulationinordernottoendangerfurthertheirsurvivalandmustonlybeauthorizedinexceptionalcircumstances.
2.
AppendixIIshallinclude:(a)allspecieswhichalthoughnotnecessarilynowthreatenedwithextinctionmaybecomesounlesstradeinspecimensofsuchspeciesissubjecttostrictregulationinordertoavoidutilizationincompatiblewiththeirsurvival;and(b)otherspecieswhichmustbesubjecttoregulationinorderthattradeinspecimensofcertainspeciesreferredtoinsubparagraph(a)ofthisparagraphmaybebroughtundereffectivecontrol.
3.
AppendixIIIshallincludeallspecieswhichanyPartyidentifiesasbeingsubjecttoregulationwithinitsjurisdictionforthepurposeofpreventingorrestrictingexploitation,andasneedingthecooperationofotherpartiesinthecontroloftrade.
4.
ThePartiesshallnotallowtradeinspecimensofspeciesincludedinAppendicesI,IIandIIIexceptinaccordanceARTICLEIIIENDANGEREDSPECIESARTICLEIV(2)(c)(07/83)RST/TREATY(07/83)withtheprovisionsofthepresentConvention.
ARTICLEIIIREGULATIONOFTRADEINSPECIMENSOFSPECIESINCLUDEDINAPPENDIXI1.
AlltradeinspecimensofspeciesincludedinAppendixIshallbeinaccordancewiththeprovisionsofthisArticle.
2.
TheexportofanyspecimenofaspeciesincludedinAppendixIshallrequirethepriorgrantandpresentationofanexportpermit.
Anexportpermitshallonlybegrantedwhenthefollowingconditionshavebeenmet:(a)aScientificAuthorityoftheStateofexporthasadvisedthatsuchexportwillnotbedetrimentaltothesurvivalofthatspecies;(b)aManagementAuthorityoftheStateofexportissatisfiedthatthespecimenwasnotobtainedincontraventionofthelawsofthatStatefortheprotectionoffaunaandflora;(c)aManagementAuthorityoftheStateofexportissatisfiedthatanylivingspecimenwillbesopreparedandshippedastominimizetheriskofinjury,damagetohealthorcrueltreatment;and(d)aManagementAuthorityoftheStateoftheexportissatisfiedthatanimportpermithasbeengrantedforthespecimen.
3.
TheimportofanyspecimenofaspeciesincludedinAppendixIshallrequirethepriorgrantandpresentationofanimportpermitandeitheranexportpermitorare-exportcertificate.
Animportpermitshallonlybegrantedwhenthefollowingconditionshavebeenmet:(a)aScientificAuthorityoftheStateofimporthasadvisedthattheimportwillbeforpurposeswhicharenotdetrimentaltothesurvivalofthespeciesinvolved;(b)aScientificAuthorityoftheStateofimportissatisfiedthattheproposedrecipientofalivingspecimenissuitablyequippedtohouseandcareforit;and(c)aManagementAuthorityoftheStateofimportissatisfiedthatthespecimenisnottobeusedforprimarilycommercialpurposes.
4.
There-exportofanyspecimenofaspeciesincludedinAppendixIshallrequirethepriorgrantandpresentationofare-exportcertificate.
Are-exportcertificateshallonlybegrantedwhenthefollowingconditionshavebeenmet:(a)aManagementAuthorityoftheStateofre-exportissatisfiedthatthespecimenwasimportedintothatStateinaccordancewiththeprovisionsofthepresentConvention;(b)aManagementAuthorityoftheStateofre-exportissatisfiedthatanylivingspecimenwillbesopreparedandshippedastominimizetheriskofinjury,damagetohealthorcrueltreatment;and(c)aManagementAuthorityoftheStateofre-exportissatisfiedthatanimportpermithasbeengrantedforanylivingspecimen.
5.
TheintroductionfromtheseaofanyspecimenofaspeciesincludedinAppendixIshallrequirethepriorgrantofacertificatefromaManagementAuthorityoftheStateofintroduction.
Acertificateshallonlybegrantedwhenthefollowingconditionshavebeenmet:(a)aScientificAuthorityoftheStateofintroductionadvisesthattheintroductionwillnotbedetrimentaltothesurvivalofthespeciesinvolved;(b)aManagementAuthorityoftheStateofintroductionissatisfiedthattheproposedrecipientofalivingspecimenissuitablyequippedtohouseandcareforit;and(c)aManagementAuthorityoftheStateofintroductionissatisfiedthatthespecimenisnottobeusedforprimarilycommercialpurposes.
ARTICLEIVREGULATIONOFTRADEINSPECIMENSOFSPECIESINCLUDEDINAPPENDIXII1.
AlltradeinspecimensofspeciesincludedinAppendixIIshallbeinaccordancewiththeprovisionsofthisArticle.
2.
TheexportofanyspecimenofaspeciesincludedinAppendixIIshallrequirethepriorgrantandpresentationofanexportpermit.
Anexportpermitshallonlybegrantedwhenthefollowingconditionshavebeenmet:(a)aScientificAuthorityoftheStateofexporthasadvisedthatsuchexportwillnotbedetrimentaltothesurvivalofthatspecies;(b)aManagementAuthorityoftheStateofexportissatisfiedthatthespecimenwasnotobtainedincontraventionARTICLEIV(2)(c)(Cont.

AScientificAuthorityineachPartyshallmonitorboththeexportpermitsgrantedbythatStateforspecimensofspeciesincludedinAppendixIIandtheactualexportsofsuchspecimens.
WheneveraScientificAuthoritydeterminesthattheexportofspecimensofanysuchspeciesshouldbelimitedinordertomaintainthatspeciesthroughoutitsrangeatalevelconsistentwithitsroleintheecosystemsinwhichitoccursandwellabovethelevelatwhichthatspeciesmightbecomeeligibleforinclusioninAppendixI,theScientificAuthorityshalladvisetheappropriateManagementAuthorityofsuitablemeasurestobetakentolimitthegrantofexportpermitsforspecimensofthatspecies.
4.
TheimportofanyspecimenofaspeciesincludedinAppendixIIshallrequirethepriorpresentationofeitheranexportpermitorare-exportcertificate.
5.
There-exportofanyspecimenofaspeciesincludedinAppendixIIshallrequirethepriorgrantandpresentationofare-exportcertificate.
Are-exportcertificateshallonlybegrantedwhenthefollowingconditionshavebeenmet:(a)aManagementAuthorityoftheStateofre-exportissatisfiedthatthespecimenwasimportedintothatStateinaccordancewiththeprovisionsofthepresentConvention;and(b)aManagementAuthorityoftheStateofre-exportissatisfiedthatanylivingspecimenwillbesopreparedandshippedastominimizetheriskofinjury,damagetohealthorcrueltreatment.
6.
TheintroductionfromtheseaofanyspecimenofaspeciesincludedinAppendixIIshallrequirethepriorgrantofacertificatefromaManagementAuthorityoftheStateofintroduction.
Acertificateshallonlybegrantedwhenthefollowingconditionshavebeenmet:(a)aScientificAuthorityoftheStateofintroductionadvisesthattheintroductionwillnotbedetrimentaltothesurvivalofthespeciesinvolved;and(b)aManagementAuthorityoftheStateofintroductionissatisfiedthatanylivingspecimenwillbesohandledastominimizetheriskofinjury,damagetohealthorcrueltreatment.
7.
Certificatesreferredtoinparagraph6ofthisArticlemaybegrantedontheadviceofaScientificAuthority,inconsultationwithothernationalscientificauthoritiesor,whenappropriate,internationalscientificauthorities,inrespectofperiodsnotexceedingoneyearfortotalnumbersofspecimenstobeintroducedinsuchperiods.
ARTICLEVREGULATIONOFTRADEINSPECIMENSOFSPECIESINCLUDEDINAPPENDIXIII1.
AlltradeinspecimensofspeciesincludedinAppendixIIIshallbeinaccordancewiththeprovisionsofthisArticle.
2.
TheexportofanyspecimenofaspeciesincludedinAppendixIIIfromanyStatewhichhasincludedthatspeciesinAppendixIIIshallrequirethepriorgrantandpresentationofanexportpermit.
Anexportpermitshallonlybegrantedwhenthefollowingconditionshavebeenmet:(a)aManagementAuthorityoftheStateofexportissatisfiedthatthespecimenwasnotobtainedincontraventionofthelawsofthatStatefortheprotectionoffaunaandflora;and(b)aManagementAuthorityoftheStateofexportissatisfiedthatanylivingspecimenwillbesopreparedandshippedastominimizetheriskofinjury,damagetohealthorcrueltreatment.
3.
TheimportofanyspecimenofaspeciesincludedinAppendixIIIshallrequire,exceptincircumstancestowhichparagraph4ofthisArticleapplies,thepriorpresentationofacertificateoforiginand,wheretheimportisfromaStatewhichhasincludedthatspeciesinAppendixIII,anexportpermit.
4.
Inthecaseofre-export,acertificategrantedbytheManagementAuthorityoftheStateofre-exportthatthespecimenwasprocessedinthatStateorisbeingre-exportedshallbeacceptedbytheStateofimportasevidencethattheprovisionsofthepresentConventionhavebeencompliedwithinrespectofthespecimenconcerned.
ARTICLEVIPERMITSANDCERTIFICATES1.
PermitsandcertificatesgrantedundertheprovisionsofArticlesIII,IV,andVshallbeinaccordancewiththeprovisionsofthisArticle.
ENDANGEREDSPECIES(07/83)RST/TREATY(07/83)2.
AnexportpermitshallcontaintheinformationspecifiedinthemodelsetforthinAppendixIV,andmayonlybeusedforexportwithinaperiodofsixmonthsfromthedateonwhichitwasgranted.
3.
EachpermitorcertificateshallcontainthetitleofthepresentConvention,thenameandanyidentifyingstampoftheManagementAuthoritygrantingitandacontrolnumberassignedbytheManagementAuthority.
4.
AnycopiesofapermitorcertificateissuedbyaManagementAuthorityshallbeclearlymarkedascopiesonlyandnosuchcopymaybeusedinplaceoftheoriginal,excepttotheextentendorsedthereon.
5.
Aseparatepermitorcertificateshallberequiredforeachconsignmentofspecimens.
6.
AManagementAuthorityoftheStateofimportofanyspecimenshallcancelandretaintheexportpermitorre-exportcertificateandanycorrespondingimportpermitpresentedinrespectoftheimportofthatspecimen.
7.
Whereappropriateandfeasible,aManagementAuthoritymayaffixamarkuponanyspecimentoassistinidentifyingthespecimen.
Forthesepurposes"mark"meansanyindelibleimprint,leadsealorothersuitablemeansofidentifyingaspecimen,designedinsuchawayastorenderitsimitationbyunauthorizedpersonsasdifficultaspossible.
ARTICLEVIIEXEMPTIONSANDOTHERSPECIALPROVISIONSRELATINGTOTRADE1.
TheprovisionsofArticlesIII,IV,andVshallnotapplytothetransitortrans-shipmentofspecimensthroughorintheterritoryofaPartywhilethespecimensremaininCustomscontrol.
2.
WhereaManagementAuthorityoftheStateofexportorre-exportissatisfiedthataspecimenwasacquiredbeforetheprovisionsofthepresentConventionappliedtothatspecimen,theprovisionsofArticlesIII,IVandVshallnotapplytothatspecimenwheretheManagementAuthorityissuesacertificatetothateffect.
3.
TheprovisionsofArticlesIII,IV,Vshallnotapplytospecimensthatarepersonalorhouseholdeffects.
Thisexemptionshallnotapplywhere:(a)inthecaseofspecimensofaspeciesincludedinAppendixI,theywereacquiredbytheowneroutsidehisStateofusualresidence,andarebeingimportedintothatState;or(b)inthecaseofspecimensofspeciesincludedinAppendixII:(i)theywereacquiredbytheowneroutsidehisStateofusualresidenceandinaStatewhereremovalfromthewildoccurred;(ii)theyarebeingimportedintotheowner'sStateofusualresidence;and(iii)theStatewhereremovalfromthewildoccurredrequiresthepriorgrantofexportpermitsbeforeanyexportofsuchspecimens;unlessaManagementAuthorityissatisfiedthatthespecimenswereacquiredbeforetheprovisionsofthepresentConventionappliedtosuchspecimens.
4.
SpecimensofananimalspeciesincludedinAppendixIbredincaptivityforcommercialpurposes,orofaplantspeciesincludedinAppendixIartificiallypropagatedforcommercialpurposes,shallbedeemedtobespecimensofspeciesincludedinAppendixII.
5.
WhereaManagementAuthorityoftheStateofexportissatisfiedthatanyspecimenofananimalspecieswasbredincaptivityoranyspecimenofaplantspecieswasartificiallypropagated,orisapartofsuchananimalorplantorwasderivedtherefrom,acertificatebythatManagementAuthoritytothateffectshallbeacceptedinlieuofanyofthepermitsorcertificatesrequiredundertheprovisionsofArticleIII,IV,orV.
6.
TheprovisionsofArticlesIII,IV,andVshallnotapplytothenoncommercialloan,donationorexchangebetweenscientistsorscientificinstitutionsregisteredbyaManagementAuthorityoftheirState,ofherbariumspecimens,otherpreserved,driedorembeddedmuseumspecimens,andliveplantmaterialwhichcarryalabelissuedorapprovedbyaManagementAuthority.
7.
AManagementAuthorityofanyStatemaywaivetherequirementsofArticlesIII,IV,andVandallowthemovementwithoutpermitsorcertificatesofspecimenswhichformpartofatravellingzoo,circus,menagerie,plantexhibitionorothertravellingexhibitionprovidedthat:(a)theexporterorimporterregistersfulldetailsofsuchspecimenswiththatManagementAuthority;(b)thespecimensareineitherofthecategoriesspecifiedinparagraphs2or5ofthisArticle;and(c)theManagementAuthorityissatisfiedthatanylivingspecimenwillbesotransportedandcaredforastominimizetheriskofinjury,damagetohealthorcrueltreatment.
ENDANGEREDSPECIES(07/83)RST/TREATY(07/83)ARTICLEVIIIMEASURESTOBETAKENBYTHEPARTIES1.
ThePartiesshalltakeappropriatemeasurestoenforcetheprovisionsofthepresentConventionandtoprohibittradeinspecimensinviolationthereof.
Theseshallincludemeasures:(a)topenalizetradein,orpossessionof,suchspecimens,orboth;and(b)toprovidefortheconfiscationorreturntotheStateofexportofsuchspecimens.
2.
Inadditiontothemeasurestakenunderparagraph1ofthisArticle,aPartymay,whenitdeemsnecessary,provideforanymethodofinternalreimbursementforexpensesincurredasaresultoftheconfiscationofaspecimentradedinviolationofthemeasurestakenintheapplicationoftheprovisionsofthepresentConvention.
3.
Asfaraspossible,thePartiesshallensurethatspecimensshallpassthroughanyformalitiesrequiredfortradewithaminimumofdelay.
Tofacilitatesuchpassage,aPartymaydesignateportsofexitandportsofentryatwhichspecimensmustbepresentedforclearance.
ThePartiesshallensurefurtherthatalllivingspecimens,duringanyperiodoftransit,holdingorshipment,areproperlycaredforsoastominimizetheriskofinjury,damagetohealthorcrueltreatment.
4.
Wherealivingspecimenisconfiscatedasaresultofmeasuresreferredtoinparagraph1ofthisArticle:(a)ThespecimenshallbeentrustedtoaManagementAuthorityoftheStateofconfiscation;(b)theManagementAuthorityshall,afterconsultationwiththeStateofexport,returnthespecimentothatStateattheexpenseofthatState,ortoarescuecentreorsuchotherplaceastheManagementAuthoritydeemsappropriateandconsistentwiththepurposesofthepresentConvention;and(c)theManagementAuthoritymayobtaintheadviceofaScientificAuthority,ormay,wheneveritconsidersitdesirable,consulttheSecretariatinordertofacilitatethedecisionundersubparagraph(b)ofthisparagraph,includingthechoiceofarescuecentreorotherplace.
5.
Arescuecentreasreferredtoinparagraph4ofthisArticlemeansaninstitutiondesignatedbyaManagementAuthoritytolookafterthewelfareoflivingspecimens,particularlythosethathavebeenconfiscated.
6.
EachPartyshallmaintainrecordsoftradeinspecimensofspeciesincludedinAppendicesI,IIandIIIwhichshallcover:(a)thenamesandaddressesofexportersandimporters;and(b)thenumberandtypeofpermitsandcertificatesgrantedtheStateswithwhichsuchtradeoccurred;thenumbersorquantitiesandtypesofspecimens,namesofspeciesasincludedinAppendicesI,IIandIIIand,whereapplicable,thesizeandsexofthespecimensinquestion.
7.
EachPartyshallprepareperiodicreportsonitsimplementationofthepresentConventionandshalltransmittotheSecretariat:(a)anannualreportcontainingasummaryoftheinformationspecifiedinsubparagraph(b)ofparagraph6ofthisArticle;and(b)abiennialreportonlegislative,regulatoryandadministrativemeasurestakentoenforcetheprovisionsofthepresentConvention.
8.
Theinformationreferredtoinparagraph7ofthisArticleshallbeavailabletothepublicwherethisisnotinconsistentwiththelawofthePartyconcerned.
ARTICLEIXMANAGEMENTANDSCIENTIFICAUTHORITIES1.
EachpartyshalldesignateforthepurposesofthepresentConvention:(a)oneormoreManagementAuthoritiescompetenttograntpermitsorcertificatesonbehalfofthatParty;and(b)oneormoreScientificAuthorities.
2.
AStatedepositinganinstrumentofratification,acceptance,approvaloraccessionshallatthattimeinformtheDepositaryGovernmentofthenameandaddressoftheManagementAuthorityauthorizedtocommunicatewithotherPartiesandwiththeSecretariat.
3.
AnychangesinthedesignationsorauthorizationsundertheprovisionsofthisArticleshallbecommunicatedbythePartyconcernedtotheSecretariatfortransmissiontoallotherParties.
4.
AnyManagementAuthorityreferredtoinparagraph2ofthisArticleshallifsorequestedbytheSecretariatortheENDANGEREDSPECIES(07/83)RST/TREATY(07/83)ManagementAuthorityofanotherParty,communicatetoitimpressionofstamps,sealsorotherdevicesusedtoauthenticatepermitsorcertificates.
ARTICLEXTRADEWITHSTATESNOTPARTYTOTHECONVENTIONWhereexportorre-exportisto,orimportisfrom,aStatenotapartytothepresentConvention,comparabledocumentationissuedbythecompetentauthoritiesinthatStatewhichsubstantiallyconformswiththerequirementsofthepresentConventionforpermitsandcertificatesmaybeacceptedinlieuthereofbyanyParty.
ARTICLEXICONFERENCEOFTHEPARTIES1.
TheSecretariatshallcallameetingoftheConferenceofthePartiesnotlaterthantwoyearsaftertheentryintoforceofthepresentConvention.
2.
ThereaftertheSecretariatshallconveneregularmeetingsatleastonceeverytwoyears,unlesstheconferencedecidesotherwise,andextraordinarymeetingsatanytimeonthewrittenrequestofatleastone-thirdoftheParties.
3.
Atmeetings,whetherregularorextraordinary,thePartiesshallreviewtheimplementationofthepresentConventionandmay:(a)makesuchprovisionasmaybenecessarytoenabletheSecretariattocarryoutitsduties;(b)considerandadoptamendmentstoAppendicesIandIIinaccordancewithArticleXV;(c)reviewtheprogressmadetowardstherestorationandconservationofthespeciesincludedinAppendicesI,IIandIII;(d)receiveandconsideranyreportspresentedbytheSecretariatorbyanyParty;and(e)whereappropriate,makerecommendationsforimprovingtheeffectivenessofthepresentConvention.
4.
Ateachregularmeeting,thePartiesmaydeterminethetimeandvenueofthenextregularmeetingtobeheldinaccordancewiththeprovisionsofparagraph2ofthisArticle.
5.
Atanymeeting,thePartiesmaydetermineandadoptrulesofprocedureforthemeeting.
6.
TheUnitedNations,itsSpecializedAgenciesandtheInternationalAtomicEnergyAgency,aswellasanyStatenotaPartytotheConvention,mayberepresentedatmeetingsoftheConferencebyobservers,whoshallhavetherighttoparticipatebutnottovote.
7.
Anybodyoragencytechnicallyqualifiedinprotection,conservationormanagementofwildfaunaandflora,inthefollowingcategories,whichhasinformedtheSecretariatofitsdesiretoberepresentedatmeetingsoftheConferencebyobservers,shallbeadmittedunlessatleastone-thirdofthePartiespresentobject:(a)internationalagenciesorbodies,eithergovernmentalornongovernmental,andnationalgovernmentalagenciesandbodies;and(b)nationalnongovernmentalagenciesorbodieswhichhavebeenapprovedforthispurposebytheStateinwhichtheyarelocated.
Onceadmitted,theseobserversshallhavetherighttoparticipatebutnottovote.
ARTICLEXIITHESECRETARIAT1.
UponentryintoforceofthepresentConvention,aSecretariatshallbeprovidedbytheExecutiveDirectoroftheUnitedNationsEnvironmentProgramme.
Totheextentandinthemannerheconsidersappropriate,hemaybeassistedbysuitableintergovernmentalornongovernmentalinternationalornationalagenciesandbodiestechnicallyqualifiedinprotection,conservationandmanagementofwildfaunaandflora.
2.
ThefunctionsoftheSecretariatshallbe:(a)toarrangeforandservicemeetingsoftheParties;(b)toperformthefunctionsentrustedtoitundertheprovisionsofArticlesXVandXVIofthepresentConvention;(c)toundertakescientificandtechnicalstudiesinaccordancewithprogrammesauthorizedbytheArticleXI-7(a)(cont.

ARTICLEXIIIINTERNATIONALMEASURES1.
WhentheSecretariatinthelightofinformationreceivedissatisfiedthatanyspeciesincludedinAppendicesIorIIisbeingaffectedadverselybytradeinspecimensofthatspeciesorthattheprovisionsofthepresentConventionarenotbeingeffectivelyimplemented,itshallcommunicatesuchinformationtotheauthorizedManagementAuthorityofthePartyorPartiesconcerned.
2.
WhenanyPartyreceivesacommunicationasindicatedinparagraph1ofthisArticle,itshall,assoonaspossible,informtheSecretariatofanyrelevantfactsinsofarasitslawspermitand,whereappropriate,proposeremedialaction.
WherethePartyconsidersthataninquiryisdesirable,suchinquirymaybecarriedoutbyoneormorepersonsexpresslyauthorizedbytheParty.
3.
TheinformationprovidedbythePartyorresultingfromanyinquiryasspecifiedinparagraph2ofthisArticleshallbereviewedbythenextConferenceofthePartieswhichmaymakewhateverrecommendationsitdeemsappropriate.
ARTICLEXIVEFFECTONDOMESTICLEGISLATIONANDINTERNATIONALCONVENTIONS1.
TheprovisionsofthepresentConventionshallinnowayaffecttherightofPartiestoadopt:(a)stricterdomesticmeasuresregardingtheconditionsfortrade,takingpossessionortransportofspecimensofspeciesincludedinAppendicesI,IIandIII,orthecompleteprohibitionthereof;or(b)domesticmeasuresrestrictingorprohibitingtradetakingpossession,ortransportofspeciesnotincludedinAppendicesI,IIorIII.
2.
TheprovisionsofthepresentConventionshallinnowayaffecttheprovisionsofanydomesticmeasuresortheobligationsofPartiesderivingfromanytreaty,convention,orinternationalagreementrelatingtootheraspectsoftrade,taking,possession,ortransportofspecimenswhichisinforceorsubsequentlymayenterintoforceforanyPartyincludinganymeasurepertainingtotheCustoms,publichealth,veterinaryorplantquarantinefields.
3.
TheprovisionsofthepresentConventionshallinnowayaffecttheprovisionsof,ortheobligationsderivingfrom,anytreaty,conventionorinternationalagreementconcludedorwhichmaybeconcludedbetweenStatescreatingaunionorregionaltradeagreementestablishingormaintainingacommonexternalcustomscontrolandremovingcustomscontrolbetweenthepartiestheretoinsofarastheyrelatetotradeamongtheStatesmembersofthatunionoragreement.
4.
AStatepartytothepresentConvention,whichisalsoapartytoanyothertreaty,conventionorinternationalagreementwhichisinforceatthetimeofthecomingintoforceofthepresentConventionandundertheprovisionsofwhichprotectionisaffordedtomarinespeciesincludedinAppendixII,shallberelievedoftheobligationsimposedonitundertheprovisionsofthepresentConventionwithrespecttotradeinspecimensofspeciesincludedinAppendixIIthataretakenbyshipsregisteredinthatStateandinaccordancewiththeprovisionsofsuchothertreaty,conventionorinternationalagreement.

NotwithstandingtheprovisionsofArticlesIII,IV,andV,anyexportofaspecimentakeninaccordancewithparagraph4ofthisArticleshallonlyrequireacertificatefromaManagementAuthorityoftheStateofintroductiontotheeffectthatthespecimenwastakeninaccordancewiththeprovisionsoftheothertreaty,conventionorinternationalagreementinquestion.

NothingintheirpresentConventionshallprejudicethecodificationanddevelopmentofthelawoftheseabytheUnitedNationsConferenceontheLawoftheSeaconvenedpursuanttoResolution2750C(XXV)oftheGeneralAssemblyoftheUnitedNationsnorthepresentorfutureclaimsandlegalviewsofanyStateconcerningthelawoftheseaandthenatureandextentofcoastalandflagStatejurisdiction.
ARTICLEXVAMENDMENTSTOAPPENDICESIANDII1.
ThefollowingprovisionsshallapplyinrelationtoamendmentstoAppendicesIandIIatmeetingsoftheConferenceoftheParties:(a)AnyPartymayproposeanamendmenttoAppendixIorIIforconsiderationatthenextmeeting.
ThetextoftheproposedamendmentshallbecommunicatedtotheSecretariatatleast150daysbeforethemeeting.
TheSecretariatshallconsulttheotherPartiesandinterestedbodiesontheamendmentinaccordancewiththeprovisionsofsubparagraphs(b)and(c)ofparagraph2ofthisArticleandshallcommunicatetheresponsetoallPartiesnotlaterthan30daysbeforethemeeting.
(b)Amendmentsshallbeadoptedbyatwo-thirdsmajorityofPartiespresentandvoting.
Forthesepurposes"Partiespresentandvoting"meansPartiespresentandcastinganaffirmativeornegativevote.
Partiesabstainingfromvotingshallnotbecountedamongthetwo-thirdsrequiredforadoptinganamendment.
(c)Amendmentsadoptedatameetingshallenterintoforce90daysafterthatmeetingforallPartiesexceptthosewhichmakeareservationinaccordancewithparagraph3ofthisArticle.

ThefollowingprovisionsshallapplyinrelationtoAmendmentstoappendicesIandIIbetweenmeetingsoftheConferenceoftheParties:(a)AnyPartymayproposeanamendmenttoAppendixIorIIforconsiderationbetweenmeetingsbytheapostalproceduressetforthinthisparagraph.
(b)Formarinespecies,theSecretariatshall,uponreceivingthetextoftheproposedamendment,immediatelycommunicateittotheParties.
Itshallalsoconsultintergovernmentalbodieshavingafunctioninrelationtothosespeciesespeciallywithaviewtoobtainingscientificdatathesebodiesmaybeabletoprovideandtoensuringcoordinationwithanyconservationmeasuresenforcedbysuchbodies.
TheSecretariatshallcommunicatetheviewsexpressedanddataprovidedbythesebodiesanditsownfindingsandrecommendationstothePartiesassoonaspossible.
(c)Forspeciesotherthanmarinespecies,theSecretariatshall,uponreceivingthetextoftheproposedamendment,immediatelycommunicateittotheParties,andassoonaspossiblethereafter,itsownrecommendations.
(d)AnyPartymay,within60daysofthedateonwhichtheSecretariatcommunicateditsrecommendationstothePartiesundersubparagraphs(b)or(c)ofthisparagraph,transmittotheSecretariatanycommentsontheproposedamendmenttogetherwithanyrelevantscientificdataandinformation.
(e)TheSecretariatshallcommunicatetherepliesreceivedbytogetherwithitsownrecommendationstothePartiesassoonaspossible.
(f)IfnoobjectiontotheproposedamendmentisreceivedbytheSecretariatwithin30daysofthedatetherepliesandrecommendationswerecommunicatedundertheprovisionsofsubparagraph(e)ofthisparagraph,theamendmentshallenterintoforce90dayslaterforallPartiesexceptthosewhichmakeareservationinaccordancewithparagraph3ofthisArticle.
(g)IfanobjectionbyanyPartyisreceivedbytheSecretariat,theproposedamendmentshallbesubmittedtoapostalvoteinaccordancewiththeprovisionsofsubparagraph(h),(i)and(j)ofthisparagraph.
(h)TheSecretariatshallnotifythePartiesthatnotificationofobjectionhasbeenreceived.
(i)UnlesstheSecretariatreceivesthevotesfor,againstorinabstentionfromatleastone-halfofthePartieswithin60daysofthedateofnotificationundersubparagraph(h)ofthisparagraph,theproposedamendmentshallbereferredtothenextmeetingoftheConferenceforfurtherconsideration.
(j)Providedthatvotesarereceivedfromone-halfoftheParties,theamendmentshallbeadoptedbyatwo-thirdsmajorityofPartiescastinganaffirmativeornegativevote.
(k)TheSecretariatshallnotifyallPartiesoftheresultofthevote.

Duringtheperiodof90daysprovidedforbysubparagraph(c)ofparagraph1orsubparagraph(1)ofparagraph2ofthisArticle,anyPartymaybynotificationinwritingtotheDepositaryGovernmentmakeareservationwithrespecttotheamendment.
Untilsuchreservationiswithdrawn,thePartyshallbetreatedasaStatenotaPartytothepresentConventionwithrespecttotradeinthespeciesconcerned.
ARTICLEXVIAPPENDIXIIIANDAMENDMENTSTHERETO1.
AnyPartymayatanytimesubmittotheSecretariatalistofspecieswhichitidentifiesasbeingsubjecttoregulationwithinitsjurisdictionforthepurposementionedinparagraph3ofArticleII.
AppendixIIIshallincludethenamesofthePartiessubmittingthespeciesforinclusiontherein,thescientificnamesofthespeciessosubmitted,andanypartsorderivativesofanimalsorplantsconcernedthatarespecifiedinrelationtothespeciesforthepurposesofsubparagraph(b)ofArticleI.
2.
Eachlistsubmittedundertheprovisionsofparagraph1ofthisArticleshallbecommunicatedtothePartiesbytheSecretariatassoonaspossibleafterreceivingit.
ThelistshalltakeeffectaspartofAppendixIII90daysafterthedateofsuchcommunication.
Atanytimeafterthecommunicationofsuchlist,anyPartymaybynotificationinwritingtotheDepositaryGovernmententerareservationwithrespecttoanyspeciesoranypartsorderivatives,anduntilsuchreservationiswithdrawn,theStateshallbetreatedasaStatenotaPartytothepresentConventionwithrespecttotradeinthespeciesorpartorderivativeconcerned.
3.
APartywhichhassubmittedaspeciesforinclusioninAppendixIIImaywithdrawitatanytimebynotificationtotheSecretariatwhichshallcommunicatethewithdrawaltoallParties.
Thewithdrawalshalltakeeffect30daysafterthedateofsuchcommunication.
4.
AnyPartysubmittingalistundertheprovisionsofparagraph1ofthisArticleshallsubmittotheSecretariatacopyofalldomesticlawsandregulationsapplicabletotheprotectionofsuchspecies,togetherwithanyinterpretationswhichthePartyamydeemappropriateortheSecretariatmayrequest.
ThePartyshall,foraslongasthespeciesinquestionisincludedinAppendixIII,submitanyamendmentsofsuchlawsandregulationsoranynewinterpretationsastheyareadopted.
ARTICLEXVIIAMENDMENTOFTHECONVENTION1.
AnextraordinarymeetingoftheConferenceofthePartiesshallbeconvenedbytheSecretariatonthewrittenrequestofatleastone-thirdofthePartiestoconsiderandadoptamendmentstothepresentConvention.
Suchamendmentsshallbeadoptedbyatwo-thirdsmajorityofPartiespresentandvoting.
Forthesepurposes"Partiespresentandvoting"meansPartiespresentandcastinganaffirmativeornegativevote.
Partiesabstainingfromthevotingshallnotbecountedamongthetwo-thirdsrequiredforadoptinganamendment.
2.
ThetextofanyproposedamendmentshallbecommunicatedbytheSecretariattoallPartiesatleast90daysbeforethemeeting.
3.
AnamendmentshallenterintoforceforthePartieswhichhaveacceptedit60daysaftertwo-thirdsofthePartieshavedepositedaninstrumentofacceptanceoftheamendmentwiththeDepositaryGovernment.
Thereafter,theamendmentshallenterintoforceforanyotherParty60daysafterthatPartydepositsitsinstrumentsofacceptanceoftheamendment.

AnydisputewhichmayarisebetweentwoormorePartieswithrespecttotheinterpretationorapplicationoftheprovisionsofthepresentConventionshallbesubjecttonegotiationbetweenthePartiesinvolvedinthedispute.

Ifthedisputecannotberesolvedinaccordancewithparagraph1ofthisArticle,thePartiesmay,bymutualconsent,submitthedisputetoarbitration,inparticularthatofthePermanentCourtofArbitrationatTheHague,andthePartiessubmittingthedisputeshallbeboundbythearbitraldecision.
ARTICLEXIXSIGNATUREThepresentConventionshallbeopenforsignatureatWashingtonuntil30thApril1973andthereafteratBerneuntil31stDecember1974.
ARTICLEXXRATIFICATION,ACCEPTANCE,APPROVALThepresentConventionshallbesubjecttoratification,acceptanceorapproval.
Instrumentsofratification,acceptanceorapprovalshallbedepositedwiththeGovernmentoftheSwissConfederationwhichshallbetheDepositaryGovernment.
ARTICLEXXIACCESSIONThepresentConventionshallbeopenindefinitelyforaccession.
InstrumentsofaccessionshallbedepositedwiththeDepositaryGovernment.
ARTICLEXXIIENTRYINTOFORCE1.
ThepresentConventionshallenterintoforce90daysafterthedateofdepositofthetenthinstrumentofratification,acceptance,approvaloraccession,withtheDepositaryGovernment.

ForeachStatewhichratifies,acceptsorapprovesthepresentConventionoraccedestheretoafterthedepositofthetenthinstrumentofratification,acceptance,approvaloraccession,thepresentConventionshallenterintoforce90daysafterthedepositbysuchStateofitsinstrumentofratification,acceptance,approvaloraccession.

TheprovisionsofthepresentConventionshallnotbesubjecttogeneralreservations.
SpecificreservationsmaybeenteredinaccordancewiththeprovisionsofthisArticleandArticlesXVandXVI.

AnyStatemay,ondepositingitsinstrumentofratification,acceptance,approvaloraccession,enteraspecificreservationwithregardto:(a)anyspeciesincludedinAppendixI,IIorIII;or(b)anypartsorderivativesspecifiedinrelationtoaspeciesincludedinAppendixIII.

UntilaPartywithdrawsitsreservationenteredundertheprovisionsofthisArticle,itshallbetreatedasaStatenotaPartytothepresentConventionwithrespecttotradeintheparticularspeciesorpartsorderivativesspecifiedinsuchreservation.
