(b)Assurethemedicalaccountabilityforreimbursedcareprovidedbyacertifiedhealthfacilityoragencyparticipatinginafederalorstatehealthprogram.

7(3)Ahealthfacilityoragencyshallhavethephysician,professionalnursing,healthprofessional,technicalandsupportivepersonnel,andthetechnical,diagnostic,andtreatmentservicesandequipmentnecessarytoassurethesafeperformanceofthehealthcareundertakenbyorinthefacilityoragency.

Thedepartmentshallnotassignanindividualtobeamemberofasurveyteamforpurposesofasurvey,evaluation,orconsultationvisitatanursinghomeinwhichheorshewasanemployeewithinthepreceding5years.
(2)Thedepartmentofconsumerandindustryservicesshallmakeatleastabiennialvisittoeachlicensedclinicallaboratory,eachnursinghome,andeachhospiceresidenceforthepurposesofsurvey,evaluation,andconsultation.
Thedepartmentofconsumerandindustryservicesshallsemiannuallyprovideforjointtrainingwithnursinghomesurveyorsandprovidersonatleast1ofthe10mostfrequentlyissuedfederal12citationsinthisstateduringthepastcalendaryear.
Thedepartmentofconsumerandindustryservicesshalldevelopaprotocolforthereviewofcitationpatternscomparedtoregionaloutcomesandstandardsandcomplaintsregardingthenursinghomesurveyprocess.
Thereviewwillresultinareportprovidedtothelegislature.
Exceptasotherwiseprovidedinthissubsection,beginningwithhisorherfirstfullrelicensureperiodafterJune20,2000,eachmemberofadepartmentofconsumerandindustryservicesnursinghomesurveyteamwhoisahealthprofessionallicenseeunderarticle15shallearnnotlessthan50%ofhisorherrequiredcontinuingeducationcredits,ifany,ingeriatriccare.
Ifamemberofanursinghomesurveyteamisapharmacistlicensedunderarticle15,heorsheshallearnnotlessthan30%ofhisorherrequiredcontinuingeducationcreditsingeriatriccare.
(3)Thedepartmentofconsumerandindustryservicesshallmakeabiennialvisittoeachhospitalforsurveyandevaluationforthepurposeoflicensure.
Subjecttosubsection(6),thedepartmentmaywaivethebiennialvisitrequiredbythissubsectionifahospital,aspartofatimelyapplicationforlicenserenewal,requestsawaiverandsubmitsbothofthefollowingandifalloftherequirementsofsubsection(5)aremet:(a)EvidencethatitiscurrentlyfullyaccreditedbyabodywithexpertiseinhospitalaccreditationwhosehospitalaccreditationsareacceptedbytheUnitedStatesdepartmentofhealthandhumanservicesforpurposesofsection1865ofpartCoftitleXVIIIofthesocialsecurityact,42U.

(9)Thedepartmentofconsumerandindustryservicesoralocalhealthdepartmentshallconductinvestigationsorinspections,otherthaninspectionsoffinancialrecords,ofacountymedicalcarefacility,homefortheaged,nursinghome,orhospiceresidencewithoutpriornoticetothehealthfacilityoragency.
Anemployeeofastateagencychargedwithinvestigatingorinspectingthehealthfacilityoragencyoranemployeeofalocalhealthdepartmentwhodirectlyorindirectlygivespriornoticeregardinganinvestigationoraninspection,otherthananinspectionofthefinancialrecords,tothehealthfacilityoragencyortoanemployeeofthehealthfacilityoragency,isguiltyofamisdemeanor.
Consultationvisitsthatarenotforthepurposeofannualorfollow-upinspectionorsurveymaybeannounced.
(10)Thedepartmentofconsumerandindustryservicesshallmaintainarecordindicatingwhetheravisitandinspectionisannouncedorunannounced.
Informationgatheredateachvisitandinspection,whetherannouncedorunannounced,shallbetakenintoaccountinlicensuredecisions.
(11)Thedepartmentofconsumerandindustryservicesshallrequireperiodicreportsandahealthfacilityoragencyshallgivethedepartmentaccesstobooks,records,andotherdocumentsmaintainedbyahealthfacilityoragencytotheextentnecessarytocarryoutthepurposeofthisarticleandtherulespromulgatedunderthisarticle.
Thedepartmentshallrespecttheconfidentialityofapatient'sclinicalrecordandshallnotdivulgeordisclosethecontentsoftherecordsinamannerthatidentifiesanindividual14exceptundercourtorder.
Thedepartmentmaycopyhealthfacilityoragencyrecordsasrequiredtodocumentfindings.
(12)Thedepartmentofconsumerandindustryservicesmaydelegatesurvey,evaluation,orconsultationfunctionstoanotherstateagencyortoalocalhealthdepartmentqualifiedtoperformthosefunctions.
However,thedepartmentshallnotdelegatesurvey,evaluation,orconsultationfunctionstoalocalhealthdepartmentthatownsoroperatesahospiceorhospiceresidencelicensedunderthisarticle.

(1)Beginningontheeffectivedateoftheamendatoryactthataddedsection20935,uponadeterminationthatahealthfacilityoragencyisincompliancewiththisarticleandtherulespromulgatedunderthisarticle,thedepartmentshallissueaninitiallicensewithin6monthsaftertheapplicantfilesacompletedapplication.
Receiptoftheapplicationisconsideredthedatetheapplicationisreceivedbyanyagencyordepartmentofthisstate.
Iftheapplicationisconsideredincompletebythedepartment,thedepartmentshallnotifytheapplicantinwritingormakethenoticeelectronicallyavailablewithin30daysafterreceiptoftheincompleteapplication,describingthe18deficiencyandrequestingadditionalinformation.
Ifthedepartmentidentifiesadeficiencyorrequiresthefulfillmentofacorrectiveactionplan,the6-monthperiodistolleduntileitherofthefollowingoccurs:(a)Uponnotificationbythedepartmentofadeficiency,untilthedatetherequestedinformationisreceivedbythedepartment.

Failuretoissueordenyalicensewithinthetimeperiodrequiredunderthissectiondoesnotallowthedepartmenttootherwisedelayprocessinganapplication.
Thecompletedapplicationshallbeplacedinsequencewithothercompletedapplicationsreceivedatthatsametime.
Thedepartmentshallnotdiscriminateagainstanapplicantintheprocessingoftheapplicationbaseduponthefactthattheapplicationfeewasrefundedordiscountedunderthissubsection.
Thedepartmentmayissueanonrenewabletemporarypermitfornotmorethan6monthsifadditionaltimeisneededtomakeaproperinvestigationortopermittheapplicanttoundertakeremedialactionrelatedtooperationalorproceduraldeficienciesoritemsofnoncompliance.
Atemporarypermitshallnotbeissuedtocoverdeficienciesinphysicalplantrequirements.
(4)Exceptasprovidedinpart217,thedepartmentmayissueaprovisionallicensefornotmorethan3consecutiveyearstoanapplicantwhotemporarilyisunabletocomplywiththerulesastothephysicalplantowned,maintained,oroperatedbyahealthfacilityoragencyexceptasotherwiseprovidedinthisarticle.
AprovisionallicenseshallnotbeissuedtoanewhealthfacilityoragencyorafacilityoragencywhoseownershipistransferredafterSeptember30,1978,unlessthefacilityoragencywaslicensedandoperatingunderthisarticleorapriorlawfornotlessthan5years.
Provisionallicensureunderactsrepealedbythiscodeshallbecountedagainstthe3-yearmaximumforlicensure.
(5)Thedepartment,inordertoprotectthepeopleofthisstate,shallprovideaprocedurefortheorderlyclosingofafacilityifitisunabletomaintainitslicenseunderthissection.
(6)Exceptasprovidedinpart217,thedepartment,uponfindingthatahealthfacilityoragencyisnotoperatinginaccordwiththerequirementsofitslicense,may:19(a)Issueanorderdirectingthelicenseeto:(i)Discontinueadmissions.
(ii)Transferselectedpatientsoutofthefacility.
(iii)Reduceitslicensedcapacity.
(iv)Complywithspecificrequirementsforlicensureorcertificationasappropriate.
(b)Throughtheofficeoftheattorneygeneral,initiatemisdemeanorproceedingsagainstthelicenseeasprovidedinsection20199(1).
(7)Anorderissuedundersubsection(6)shallbegovernedbythenoticeandhearingrequirementsofsection20168(1)andthestatusrequirementsofsection20168(2).
(8)BeginningOctober1,2005,thedirectorofthedepartmentshallsubmitareportbyDecember1ofeachyeartothestandingcommitteesandappropriationssubcommitteesofthesenateandhouseofrepresentativesconcernedwithpublichealthissues.
Thedirectorshallincludeallofthefollowinginformationinthereportconcerningtheprecedingfiscalyear:(a)Thenumberofinitialapplicationsthedepartmentreceivedandcompletedwithinthe6-monthtimeperiodrequiredundersubsection(1).
(b)Thenumberofapplicationsrequiringarequestforadditionalinformation.
(c)Thenumberofapplicationsdenied.

Anindividualwhoisexemptunderthissubdivisionisnotlimitedtoworkingwithinthehealthfacilityoragencywithwhichheorsheisemployedby,underindependentcontractto,orgrantedclinicalprivilegesonApril1,2006.
Thatindividualmaytransfertoanotherhealthfacilityoragencythatisunderthesameownershipwithwhichheorshewasemployed,undercontract,orgrantedprivileges.
Ifthatindividualwishestotransfertoanotherhealthfacilityoragencythatisnotunderthesameownership,heorshemaydosoprovidedthatacriminalhistorycheckisconductedbythenewhealthfacilityoragencyinaccordancewithsubsection(4).
Ifanindividualwhoisexemptunderthissubdivisionissubsequentlyconvictedofacrimedescribedundersubsection(1)(a)to(g)orfoundtobethesubjectofasubstantiatedfindingdescribedundersubsection(1)(i)oranorderordispositiondescribedundersubsection(1)(h),orisfoundtohavebeenconvictedofarelevantcrimedescribedundersubsection(1)(a),thenheorsheisnolongerexemptandshallbeterminatedfromemploymentordeniedemployment.

(3)Anindividualwhoappliesforemploymenteitherasanemployeeorasanindependentcontractororforclinicalprivilegeswithahealthfacilityoragencythatisanursinghome,countymedicalcarefacility,hospice,hospitalthatprovidesswingbedservices,homefortheaged,orhomehealthagencyandhasreceivedagoodfaithofferofemployment,anindependentcontract,orclinicalprivilegesfromthehealthfacilityoragencyshallgivewrittenconsentatthetimeofapplicationforthedepartmentofstatepolicetoconductaninitialcriminalhistorycheckunderthissection,alongwithidentificationacceptabletothedepartmentofstatepolice.
(4)Uponreceiptofthewrittenconsentandidentificationrequiredundersubsection(3),ahealthfacilityoragencythatisanursinghome,countymedicalcarefacility,28hospice,hospitalthatprovidesswingbedservices,homefortheaged,orhomehealthagencythathasmadeagoodfaithofferofemploymentoranindependentcontractorclinicalprivilegestotheapplicantshallmakearequesttothedepartmentofstatepolicetoconductacriminalhistorycheckontheapplicant,toinputtheapplicant'sfingerprintsintotheautomatedfingerprintidentificationsystemdatabase,andtoforwardtheapplicant'sfingerprintstothefederalbureauofinvestigation.
Thedepartmentofstatepoliceshallrequestthefederalbureauofinvestigationtomakeadeterminationoftheexistenceofanynationalcriminalhistorypertainingtotheapplicant.
Theapplicantshallprovidethedepartmentofstatepolicewithasetoffingerprints.
Therequestshallbemadeinamannerprescribedbythedepartmentofstatepolice.
Thehealthfacilityoragencyshallmakethewrittenconsentandidentificationavailabletothedepartmentofstatepolice.
Thehealthfacilityoragencyshallmakearequesttotherelevantlicensingorregulatorydepartmenttoconductacheckofallrelevantregistriesestablishedpursuanttofederalandstatelawandregulationsforanysubstantiatedfindingsofabuse,neglect,ormisappropriationofproperty.
Ifthedepartmentofstatepoliceorthefederalbureauofinvestigationchargesafeeforconductingtheinitialcriminalhistorycheck,ahealthfacilityoragencythatisanursinghome,countymedicalcarefacility,hospice,hospitalthatprovidesswingbedservices,orhomehealthagencyshallpaythecostofthecharge.
Ifthedepartmentofstatepoliceorthefederalbureauofinvestigationchargesafeeforconductingtheinitialcriminalhistorycheck,thedepartmentshallpaythecostoforreimbursethechargeforahealthfacilityoragencythatisahomefortheaged.
Thehealthfacilityoragencyshallnotseekreimbursementforachargeimposedbythedepartmentofstatepoliceorthefederalbureauofinvestigationfromtheindividualwhoisthesubjectoftheinitialcriminalhistorycheck.
Aprospectiveemployee,oraprospectiveindependentcontractorcoveredunderthissectionmaynotbechargedforthecostofaninitialcriminalhistorycheckrequiredunderthissection.
Thedepartmentofstatepoliceshallconductacriminalhistorycheckontheapplicantnamedintherequest.
Thedepartmentofstatepoliceshallprovidethedepartmentwithawrittenreportofthecriminalhistorycheckconductedunderthissubsectionifthecriminalhistorycheckcontainsanycriminalhistoryrecordinformation.
Thereportshallcontainanycriminalhistoryrecordinformationontheapplicantmaintainedbythedepartmentofstatepolice.
Thedepartmentofstatepoliceshallprovidetheresultsofthefederalbureauofinvestigationdeterminationtothedepartmentwithin30daysaftertherequestismade.
Iftherequestinghealthfacilityoragencyisnotastatedepartmentoragencyandifacriminalconvictionisdisclosedonthewrittenreportofthecriminalhistorycheckorthefederalbureauofinvestigationdetermination,thedepartmentshallnotifythehealthfacilityoragencyandtheapplicantinwritingofthetypeofcrimedisclosedonthewrittenreportofthecriminalhistorycheckorthefederalbureauofinvestigationdeterminationwithoutdisclosingthedetailsofthecrime.

(5)Ifahealthfacilityoragencythatisanursinghome,countymedicalcarefacility,hospice,hospitalthatprovidesswingbedservices,homefortheaged,orhomehealthagencydeterminesitnecessarytoemployorgrantclinicalprivilegestoanapplicantbeforereceivingtheresultsoftheapplicant'scriminalhistorycheckunderthissection,thehealthfacilityoragencymayconditionallyemployorgrantconditionalclinicalprivilegestotheindividualifallofthefollowingapply:(a)Thehealthfacilityoragencyrequeststhecriminalhistorycheckunderthissectionuponconditionallyemployingorconditionallygrantingclinicalprivilegestotheindividual.

(c)Acaseinwhichahealthprofessionalresignsorterminatesacontractorwhosecontractisnotrenewedinsteadofthehealthfacilitytakingdisciplinaryactionagainstthehealthprofessional.
34(6)Uponrequestbyanotherhealthfacilityoragencyseekingareferenceforpurposesofchangingorgrantingstaffprivileges,credentials,oremployment,ahealthfacilityoragencythatemploys,contractswith,orgrantsprivilegestohealthprofessionalslicensedorregisteredunderarticle15shallnotifytherequestinghealthfacilityoragencyofanydisciplinaryorotheractionreportableundersubsection(5)thatithastakenagainstahealthprofessionallicensedorregisteredunderarticle15andemployedby,undercontractto,orgrantedprivilegesbythehealthfacilityoragency.
(7)Forthepurposeofreportingdisciplinaryactionsunderthissection,ahealthfacilityoragencyshallincludeonlythefollowingintheinformationprovided:(a)Thenameofthelicenseeorregistrantagainstwhomdisciplinaryactionhasbeentaken.
(b)Adescriptionofthedisciplinaryactiontaken.
(c)Thespecificgroundsforthedisciplinaryactiontaken.

Ifarefusaloftreatmentpreventsahealthfacilityoragencyoritsstafffromprovidingappropriatecareaccordingtoethicalandprofessionalstandards,therelationshipwiththepatientorresidentmaybeterminateduponreasonablenotice.
39(g)Apatientorresidentisentitledtoexercisehisorherrightsasapatientorresidentandasacitizen,andtothisendmaypresentgrievancesorrecommendchangesinpoliciesandservicesonbehalfofhimselforherselforotherstothehealthfacilityoragencystaff,togovernmentalofficials,ortoanotherpersonofhisorherchoicewithinoroutsidethehealthfacilityoragency,freefromrestraint,interference,coercion,discrimination,orreprisal.
Apatientorresidentisentitledtoinformationaboutthehealthfacility'soragency'spoliciesandproceduresforinitiation,review,andresolutionofpatientorresidentcomplaints.
(h)Apatientorresidentisentitledtoinformationconcerninganexperimentalprocedureproposedasapartofhisorhercareandhastherighttorefusetoparticipateintheexperimentalprocedurewithoutjeopardizinghisorhercontinuingcare.
(i)Apatientorresidentisentitledtoreceiveandexamineanexplanationofhisorherbillregardlessofthesourceofpaymentandtoreceive,uponrequest,informationrelatingtofinancialassistanceavailablethroughthehealthfacilityoragency.
(j)Apatientorresidentisentitledtoknowwhoisresponsibleforandwhoisprovidinghisorherdirectcare,isentitledtoreceiveinformationconcerninghisorhercontinuinghealthneedsandalternativesformeetingthoseneeds,andtobeinvolvedinhisorherdischargeplanning,ifappropriate.
(k)Apatientorresidentisentitledtoassociateandhaveprivatecommunicationsandconsultationswithhisorherphysician,attorney,oranyotherpersonofhisorherchoiceandtosendandreceivepersonalmailunopenedonthesamedayitisreceivedatthehealthfacilityoragency,unlessmedicallycontraindicatedasdocumentedinthemedicalrecordbytheattendingphysicianoraphysician'sassistanttowhomthephysicianhasdelegatedtheperformanceofmedicalcareservices.
Apatient'sorresident'scivilandreligiousliberties,includingtherighttoindependentpersonaldecisionsandtherighttoknowledgeofavailablechoices,shallnotbeinfringedandthehealthfacilityoragencyshallencourageandassistinthefullestpossibleexerciseoftheserights.
Apatientorresidentmaymeetwith,andparticipatein,theactivitiesofsocial,religious,andcommunitygroupsathisorherdiscretion,unlessmedicallycontraindicatedasdocumentedbytheattendingphysicianinthemedicalrecord.
(l)Apatientorresidentisentitledtobefreefrommentalandphysicalabuseandfromphysicalandchemicalrestraints,exceptthoserestraintsauthorizedinwritingbytheattendingphysicianoraphysician'sassistanttowhomthephysicianhasdelegatedtheperformanceofmedicalcareservicesforaspecifiedandlimitedtimeorasarenecessitatedbyanemergencytoprotectthepatientorresidentfrominjurytoselforothers,inwhichcasetherestraintmayonlybeappliedbyaqualifiedprofessionalwhoshallsetforthinwritingthecircumstancesrequiringtheuseofrestraintsandwhoshallpromptlyreporttheactiontotheattendingphysicianorphysician'sassistant.
Incaseofachemicalrestraint,aphysicianshallbeconsultedwithin24hoursafterthecommencementofthechemicalrestraint.
40(m)Apatientorresidentisentitledtobefreefromperformingservicesforthehealthfacilityoragencythatarenotincludedfortherapeuticpurposesintheplanofcare.
(n)Apatientorresidentisentitledtoinformationaboutthehealthfacilityoragencyrulesandregulationsaffectingpatientorresidentcareandconduct.
(o)Apatientorresidentisentitledtoadequateandappropriatepainandsymptommanagementasabasicandessentialelementofhisorhermedicaltreatment.
(3)Thefollowingadditionalrequirementsforthepolicydescribedinsubsection(2)applytolicenseesunderparts213and217:(a)Thepolicyshallbeprovidedtoeachnursinghomepatientorhomefortheagedresidentuponadmission,andthestaffofthefacilityshallbetrainedandinvolvedintheimplementationofthepolicy.
(b)Eachnursinghomepatientmayassociateandcommunicateprivatelywithpersonsofhisorherchoice.
Reasonable,regularvisitinghours,whichshallbenotlessthan8hoursperday,andwhichshalltakeintoconsiderationthespecialcircumstancesofeachvisitor,shallbeestablishedforpatientstoreceivevisitors.
Apatientmaybevisitedbythepatient'sattorneyorbyrepresentativesofthedepartmentsnamedinsection20156,duringotherthanestablishedvisitinghours.
Reasonableprivacyshallbeaffordedforvisitationofapatientwhosharesaroomwithanotherpatient.
Eachpatientshallhavereasonableaccesstoatelephone.
Amarriednursinghomepatientorhomefortheagedresidentisentitledtomeetprivatelywithhisorherspouseinaroomthatassuresprivacy.
Ifbothspousesareresidentsinthesamefacility,theyareentitledtosharearoomunlessmedicallycontraindicatedanddocumentedinthemedicalrecordbytheattendingphysicianoraphysician'sassistanttowhomthephysicianhasdelegatedtheperformanceofmedicalcareservices.
(c)Anursinghomepatientorhomefortheagedresidentisentitledtoretainandusepersonalclothingandpossessionsasspacepermits,unlesstodosowouldinfringeupontherightsofotherpatientsorresidents,orunlessmedicallycontraindicatedasdocumentedinthemedicalrecordbytheattendingphysicianoraphysician'sassistanttowhomthephysicianhasdelegatedtheperformanceofmedicalcareservices.
Eachnursinghomepatientorhomefortheagedresidentshallbeprovidedwithreasonablespace.
Attherequestofapatient,anursinghomeshallprovideforthesafekeepingofpersonaleffects,funds,andotherpropertyofapatientinaccordancewithsection21767,exceptthatanursinghomeisnotrequiredtoprovideforthesafekeepingofapropertythatwouldimposeanunreasonableburdenonthenursinghome.
(d)Anursinghomepatientorhomefortheagedresidentisentitledtotheopportunitytoparticipateintheplanningofhisorhermedicaltreatment.
Anursinghomepatientshallbefullyinformedbytheattendingphysicianofthepatient'smedicalconditionunlessmedicallycontraindicatedasdocumentedbyaphysicianinthemedicalrecord.
Eachnursinghomepatientshallbeaffordedtheopportunitytodischargehimselforherselffromthenursinghome.
41(e)Ahomefortheagedresidentmaybetransferredordischargedonlyformedicalreasons,forhisorherwelfareorthatofotherresidents,orfornonpaymentofhisorherstay,exceptasprovidedbytitleXVIIIortitleXIX.
Anursinghomepatientmaybetransferredordischargedonlyasprovidedinsections21773to21777.
Anursinghomepatientorhomefortheagedresidentisentitledtobegivenreasonableadvancenoticetoensureorderlytransferordischarge.
Thoseactionsshallbedocumentedinthemedicalrecord.
(f)Anursinghomepatientorhomefortheagedresidentisentitledtobefullyinformedbeforeoratthetimeofadmissionandduringstayofservicesavailableinthefacility,andoftherelatedchargesincludinganychargesforservicesnotcoveredundertitleXVIII,ornotcoveredbythefacility'sbasicperdiemrate.
Thestatementofservicesprovidedbythefacilityshallbeinwritingandshallincludethoserequiredtobeofferedonanas-neededbasis.
(g)Anursinghomepatientorhomefortheagedresidentisentitledtomanagehisorherownfinancialaffairs,ortohaveatleastaquarterlyaccountingofpersonalfinancialtransactionsundertakeninhisorherbehalfbythefacilityduringaperiodoftimethepatientorresidenthasdelegatedthoseresponsibilitiestothefacility.
Inaddition,apatientorresidentisentitledtoreceiveeachmonthfromthefacilityanitemizedstatementsettingforththeservicespaidforbyoronbehalfofthepatientandtheservicesrenderedbythefacility.
Theadmissionofapatienttoanursinghomedoesnotconferonthenursinghomeoritsowner,administrator,employees,orrepresentativestheauthoritytomanage,use,ordisposeofapatient'sproperty.
(h)Anursinghomepatientorapersonauthorizedbythepatientinwritingmayinspectandcopythepatient'spersonalandmedicalrecords.
Therecordsshallbemadeavailableforinspectionandcopyingbythenursinghomewithinareasonabletime,notexceeding1week,afterthereceiptofawrittenrequest.
(i)Ifanursinghomepatientdesirestreatmentbyalicensedmemberofthehealingarts,thetreatmentshallbemadeavailableunlessitismedicallycontraindicated,andthemedicalcontraindicationisjustifiedinthepatient'smedicalrecordbytheattendingphysician.
(j)Anursinghomepatienthastherighttohavehisorherparents,ifaminor,orhisorherspouse,nextofkin,orpatient'srepresentative,ifanadult,stayatthefacility24hoursadayifthepatientisconsideredterminallyillbythephysicianresponsibleforthepatient'scare.
(k)Eachnursinghomepatientshallbeprovidedwithmealsthatmeettherecommendeddietaryallowancesforthatpatient'sageandsexandthatmaybemodifiedaccordingtospecialdietaryneedsorabilitytochew.
(l)Eachnursinghomepatienthastherighttoreceiverepresentativesofapprovedorganizationsasprovidedinsection21763.
42(4)Anursinghome,itsowner,administrator,employee,orrepresentativeshallnotdischarge,harass,orretaliateordiscriminateagainstapatientbecausethepatienthasexercisedarightprotectedunderthissection.
(5)Inthecaseofanursinghomepatient,therightsenumeratedinsubsection(2)(c),(g),and(k)andsubsection(3)(d),(g),and(h)maybeexercisedbythepatient'srepresentative.
(6)Anursinghomepatientorhomefortheagedresidentisentitledtobefullyinformed,asevidencedbythepatient'sorresident'swrittenacknowledgment,beforeoratthetimeofadmissionandduringstay,ofthepolicyrequiredbythissection.
Thepolicyshallprovidethatifapatientorresidentisadjudicatedincompetentandnotrestoredtolegalcapacity,therightsandresponsibilitiessetforthinthissectionshallbeexercisedbyapersondesignatedbythepatientorresident.
Thehealthfacilityoragencyshallprovideproperformsforthepatientorresidenttoprovideforthedesignationofthispersonatthetimeofadmission.
(7)Thissectiondoesnotprohibitahealthfacilityoragencyfromestablishingandrecognizingadditionalpatients'rights.

Thedepartmentofstatepoliceshallconductthecriminalhistorycheckandprovideareportoftheresultstothelicensingorregulatorybureauofthedepartmentofhumanservices.
Thereportshallcontainanycriminalhistoryinformationonthepersonmaintainedbythedepartmentofstatepoliceandtheresultsofthecriminalrecordscheckfromthefederalbureauofinvestigation.
Thedepartmentofstatepolicemaychargethepersononwhomthecriminalhistorycheckandcriminalrecordscheckareperformedunderthissectionafeeforthechecksrequiredunderthissectionthatdoesnotexceedtheactualcostandreasonablecostofconductingthechecks.

(1)Exceptasprovidedundersubsection(2),ahomefortheagedseekingalicenseorarenewalofalicenseunderthisarticleshallhave,ataminimum,anemergencygeneratorsystemthatduringaninterruptionofthenormalelectricalsupplyiscapableofbothofthefollowing:(a)Providingnotlessthan4hoursofservice.
(b)Generatingenoughpowertoprovidelightingatallentrancesandexitsandtooperateequipmenttomaintainfiredetection,alarm,andextinguishingsystems,telephoneswitchboards,heatingplantcontrols,andothercriticalmechanicalequipmentessentialtothesafetyandwelfareoftheresidents,personnel,andvisitors.
(2)Ahomefortheagedthatislicensedunderthisarticleontheeffectivedateoftheamendatoryactthataddedthissectionisnotrequiredtocomplywithsubsection(1)untilthathomefortheagedundergoesanymajorbuildingmodification.
Asusedinthissection,"majorbuildingmodification"meansanalterationofwallsthatcreatesanewarchitecturalconfigurationorrevisiontothemechanicalorelectricalsystemsthatsignificantlyrevisesthedesignofthesystemorsystems.
Majorbuildingmodificationdoesnotincludenormalbuildingmaintenance,repair,orreplacementwithequivalentcomponentsorachangeinroomfunction.
(3)Ahomefortheagedthatisexemptfromcomplianceundersubsection(2)shallnotifythelocalmedicalcontrolauthorityandthelocallawenforcementagencythatitdoesnothaveanemergencygeneratoronsite.
Untilahomefortheagedundergoesanymajorbuildingmodificationasprovidedundersubsection(2),ahomefortheagedthatisexemptfromcomplianceundersubsection(2)shallfilewiththedepartmentacopyofthehomefortheaged'swrittenpoliciesandproceduresandexistingplansoragreementsforemergencysituations,includingintheeventofaninterruptionofthenormalelectricalsupply.
(4)Ahomefortheagedthatfailstocomplywiththissectionissubjecttoacivilpenaltyofnotmorethan$2,000.
