ThisCommonSensePrincipleconcerningwaiversharmonizeswellwithtwootherCommonSensePrinciplesthattheGovernorfurtherarticulatedinExecutiveOrderNo.

First,theGovernordirectedallagenciestotakeactiontocultivateanapproachtoregulationsthatvaluesperformance-basedoutcomesandcompliance.
Forexample,undertheproposedrulesforwaiversthatwouldyieldanetenvironmentalbenefit,theremightbeopportunitytosatisfyrequirementsusingnewtechnologyornewornontraditionalmethodsand/ormaterialsorotherinnovativeoptions.
Second,theGovernordirectedallagenciestodraftallproposedrulesandprocessessothattheypromotetransparencyandpredictabilityregardingregulatoryactivity,consistencyofbusinessregulationwithintheState,appropriateflexibility,andareasonablebalancebetweentheunderlyingregulatoryobjectivesandtheburdensimposedbytheregulatoryactivity.
WiththeserulesforwaiverstheDepartmentispromotingboththetransparencyandpredictabilitythattheGovernormandated,aswellastheflexibilityneededtoobtaintheappropriatebalancebetweentheunderlyingregulatoryobjectivesandtheburdensimposedbytheregulatoryactivity.

Inspecificandinfrequentcases,waivingcompliancewithagivenrulecouldhelpmoreeffectivelyaccomplishtheDepartment'scoremissionsthanrequiringadherencewitheveryaspectofaparticularstandardorrequirement.
TheDepartmentdoesnotintendtousethischaptertowaivestrictcompliancewithagivenrulerepeatedlyorformultiplepersonssuchthatuseofawaiverwouldbecomeawaytoroutinelyavoidcompliancewiththatrule.
NorwilltheseproposedruleslimittheuseoravailabilityofanyotherDepartmentrulethatprovidesanexception,variance,orwaiverfromstrictcompliance,ortheavailabilityofemergencyauthorizations.
TheruleswillprovideanadditionalmeansofrelieffromstrictcompliancewithDepartmentruleswhenappropriate.
Importantly,theseproposedruleswillnotentitleanypersonorentitytoawaivernorwilltheyobligetheDepartmenttowaivearuleinanysituationorforanyapplicant.
TheproposedrulesestablishcriteriatoenabletheDepartmenttoapprovewaiversincertaincircumstancesconsistentwithcarryingoutitscoremissionstomaintainandprotecttheenvironmentandprotectthepublichealth,safety,andwelfare.

Similarly,professionalssuchasaccountantsmayberetainedtosupportawaiverrequestbaseduponunduehardship.
However,retentionofprofessionalassistanceisnotrequired.
Ifthesmallbusinessdiddeterminetoretainprofessionalassistance,thecostinvolvedwillvarydependinguponthetypeandsizeofprojectinvolved,andthespecificrequirementfromwhichwaiverissought.
Accordingly,anyimpactonsmallbusinessesisanticipatedtobepositive.
Therefore,theDepartmentdoesnotbelieveitwouldbeappropriatetoprovideanydifferingstandardforapprovalofawaiverthatwouldbeapplicabletosmallbusinesses.

Sustainablesuppliesofcleanwater,cleanairandanabundanceofopenspaceandrecreationalopportunitiesalsowillassureasustainableeconomy.
"Theimplementingstrategyisto"Protecttheenvironmentbyplanningforgrowthincompactforms,atlocationsanddensitiesofusethatmakeefficientuseofexistingandplannedinfrastructureandbyincreasinginfrastructurecapacitiesandgrowthpotentialinareaswheredevelopmentwillnotdamagewaterresources,criticalhabitatsorimportantforests…"TheproposednewrulesareintendedtoallowtheDepartmenttowaivestrictcompliancewithstandardscontainedinanyoftheDepartment'srulesinappropriatecircumstanceswhereawaiverofstrictcomplianceisappropriatetoavoidunreasonable,unfairorunintendedresults,thuspotentiallyencouragingeconomicdevelopment.

Thenetenvironmentalbenefitmayincludemitigation,butitmustbebeyondwhatthewaivedrulewouldhaverequiredindependentofthewaiver.
"Publicemergency"meansasituationinwhichaFederalorStateofficialwiththeauthoritytodosodeclaresapublicemergency.
"Undulyburdensome"meansasituationinwhichthestrictcompliancewithaspecificDepartmentrulewouldresultineither:(1)actual,exceptionalhardshipforaparticularprojectorproperty;or(2)excessivecostinrelationtoanalternativemeasureofcompliancethatachievescomparableorgreaterbenefits.
"Waiver"meansadecisionbytheDepartmentpursuanttothischapterthatrelaxesstrictcompliancewithaspecificDepartmentrule,inwholeorpart,asappliedtoaspecificpersonorproperty,onthebasisoftheparticularcircumstancesofthatpersonorproperty.
